Notice of Forfeiture of Oil and Gas Lease Pursuant to Ohio – Revised Code Section 5301.332 STATE OF OHIO COUNTY OF TUSCARAWAS Zachariah D. Zifzal and Amber L. Farley, Co-Trustees, or their successor in Trust, of the David and Kimberly Zifzal Irrevocable Trust, dated September 5, 2024, being the owners of the oil, gas and minerals underlying 15.017 acres, more or less, located in Section 6, Township 9, Range 10 of Spencer Township, Guernsey County, Ohio, further described as Surface Tax Parcel Numbers 36-0000118.010 & 36-0000118.011, hereby gives notice of their intention to declare the following oil and gas lease forfeited pursuant to Ohio Re-vised Code Section 5301.332 for the following reasons: (1) the original lessee and their successors or assigns have failed and/or neglected to (i) comply with specifically described covenants provided for the lease, and/or (ii) timely and properly extend the lease pursuant to the terms and provision of such lease; and/or (2) the terms of the lease have expired and there are no producing or drilling oil and/or gas well on the leased premises. Oil and Gas Lease, from Joyce E. Howell, Guardian of the Estate of Ralph Ward Howell, to Enterprise Gas and Oil, Inc., dated May 15, 1977, and recorded on June 3, 1977, in Volume 79, Page 214 of the Lease Records of Guernsey County, Ohio, with a primary term often (2) years from May 15, 1977, and covering 266.36 acres, more or less, out of Section 6, Township 9, Range 10 of Spencer Township, Guernsey County, Ohio (the "Howell Lease"). Based on the Public Records of Guernsey County, Ohio, the Howell Lease is now owned by CGAS Appalachia, LLC, Devon Energy Production Company, LP, Tiptop Energy Production US LLC, OPM777, LLC, Brian Field, Michael J. Kias, Henry C. Shied, Hilmer C. Schmidt, William F. Van Hoy, Belden & Blake Corporation, MESH, LTD., LJB Marketing, LLC, Big Sky Energy, Inc., Am-Tek Oil Inc., and EAP Ohio, LLC It is the intention of Zachariah D. Zifzal and Amber L. Farley, Co-Trustees, or their successor in Trust, of the David and Kimberly Zifzal Irrevocable Trust, dated September 5, 2024, to file for the record an Affidavit of Forfeiture with the Guernsey County Recorder if the lessee does not file a release of record of the lease within thirty (30) days from the date of receipt of this notice.
