Notice of Forfeiture of Oil and Gas Lease
To Belden & Blake LLC, Belden & Blake and Company Limited Partnership No. 10A, Louise V. Boyd, Childrens Services Bureau, Christ Episcopal Church, Robert B. Clark, Robert J. Davis, Ecumenical Center for Religion and Health, Good Samaritan Center, Crocker National Bank, Trustee of Herold Trust, I. R. Linnard, Talbot Shelton, William H. Vodrey Estate CO J.S. Vodrey, Attorney, Barbara V. Wamelink, their successors or assigns (the "Lessees"):
Vincent James Paumier, as Successor Trustee of the Joseph P. Paumier Trust (the "Owner") owns the oil, gas, and other minerals in and underlying approximately 61.48 acres, more or less, of real property located in Section 13 of Canton Township, Stark County, Ohio, being Parcel Nos. 13-00552, 13-13736, 13-02044, and 13-08792 (the "Property"), and more fully described in Stark County Instrument No. 201208020034872.
On November 19, 1968, John C. Davis and Sarah B. Davis (the original lessors and Owner's predecessor-in-interest) leased 5.7 acres of the Property to Belden & Blake Oil Production in an oil and gas lease recorded November 21, 1968, in Stark County Lease Records Volume 161, Page 585 (the "Lease"). Pursuant to the public land records of Stark County, Ohio, the Lessees are either the original lessees under the Lease or the successors to Belden & Blake Oil Production.
Pursuant to Section 5301.332 of the Ohio Revised Code, Lessees, as successors to Belden & Blake Oil Production, its successors and assigns, are hereby notified that there are no producing wells drilled under the terms of the Lease, no operations for oil or gas being conducted on any of the lands covered by the Lease under the terms of the Lease, and no other provision holds the Lease beyond its primary term. Therefore, the Lease is forfeited, terminated, or has otherwise expired by its own terms. The Owner is not now, nor have they ever, received rents or royalties from production under the Lease, and the Owner would refuse to accept payment of rentals or royalties under the Lease if they were offered. The Owner considers the Lease to be forfeited and void.
It is the intention of the Owner to file for record an Affidavit of Forfeiture in the public land records of Stark County, Ohio, pursuant to Ohio Revised Code Section 5301.332 if Lessees, their respective successors or assigns, do not have the Lease released of record within thirty (30) days of receipt of this Notice or, if service cannot be completed by certified mail, thirty (30) days from the date of the publication of this Notice.
