Notice of Hearing

Notice of Hearing Notice to the public is hereby given that on July 6, 2026, at 9:00 a.m., in the Superior Court of Chatham County, at the courthouse in said county, a hearing will be held in the case of State of Georgia v. City of Tybee Island Building and Public Facilities Authority and City of Tybee Island, Georgia, on the petition and complaint to validate the City of Tybee Island Building and Public Facilities Authority Refunding Revenue Bond (Water and Sewer Project), Series 2026, in the principal amount of $3,125,222 (the "Series 2026 Bond"), which is authorized to be issued by a bond resolution adopted on June 11, 2026, by vote of a majority of the members of the City of Tybee Island Building and Public Facilities Authority (the "Authority"). Proceeds from the sale of said Series 2026 Bond will be used to provide financing to (i) refund and defease the outstanding City of Tybee Island Water and Sewer Revenue Bond, Series 2024, to achieve debt service costs savings to the City of Tybee Island (the "City") by reducing the debt service payments of the City for the Series 2024 Bond, and (ii) pay the fees and expenses to be incurred in connection with the issuance of the Series 2026 Bond. The Court will also adjudicate the valid and binding effect of the intergovernmental contract to be entered into between the Authority and the City, under which the City shall agree to make certain payments for the account of the Authority, which payments are pledged as security for the payment of the Series 2026 Bond sought to be validated. At said hearing all persons having a right to be heard with respect to the Series 2026 Bond and the security provided therefor, and with respect to the validation thereof, may be heard.
