Notice of Ordinance Introduction - Borough of Farmingdale PUBLIC NOTICE is hereby given that Ordinance 2026-01 entitled: "An Ordinance Amending Chapter 25, Land Use Development Regulations of the Code of the Borough of Farmingdale, County of Monmouth, State of New Jersey" was introduced at a meeting of the Borough Council of the Borough of Farmingdale, in the County of Monmouth and State of New Jersey on the 17th day of February, 2026 and was then read for the first time. The purpose of the ordinance is to amend Chapter 25, Land Development Regulations to add "Townhouse" to Article II, §25-2.2 Definitions; to amend the Zoning Map, Article IV to provide for Affordable Housing Overlay zoning district entitled "Chestnut Street / 2nd and 3rd Avenue Overlay Zone"; and to Amend Section 25-22, "Official Zoning Map", Section 25-21, "Establishment of Zones," and Section 25-34 currently "Reserved" to create a new overlay zoning district entitled "Chestnut Street / 2nd and 3rd Avenue Overlay Zone". The said Ordinance will be further considered for final passage by the Borough Council in the Borough Community Center, 13 Asbury Avenue, Farmingdale, NJ 07727 at 6:00 p.m. on March 3, 2026. At such time and place or any time or place to which said meeting may be adjourned; all persons interested will be given an opportunity to be heard concerning said Ordinance. The map can be viewed at Borough Hall or online at www.farmingdaleborough.org - By Order of the Governing Body of the Borough of Farmingdale ORDINANCE 2026-01 - BOROUGH of FARMINGDALE, COUNTY of MONMOUTH - AN ORDINANCE AMENDING CHAPTER 25, LAND DEVELOPMENT REGULATIONS, OF THE CODE OF THE BOROUGH OF FARMINGDALE COUNTY OF MONMOUTH AND STATE OF NEW JERSEY BE IT ORDAINED by the Borough Council of the Borough of Farmingdale, County of Monmouth, and State of New Jersey as follows: I PURPOSES: The purposes of this Ordinance are to amend Chapter 25, Land Development Regulations as follows: To add "Townhouse" to Article II, §25-2.2 Definitions.To amend the Zoning Map, Article IV to provide for Affordable Housing Overlay zoning district entitled "Chestnut Street / 2nd and 3rd Avenue Overlay Zone"To Amend Section 25-22, "Official Zoning Map", Section 25-21, "Establishment of Zones," and Section 25-34 currently "Reserved" to create a new overlay zoning district entitled "Chestnut Street / 2nd and 3rd Avenue Overlay Zone". Deletions are shown with strikethroughs and additions are underlined. II Article II, Definitions, Section 25-2.2 Definitions, is hereby amended to add "Townhouse" as follows: TOWNHOUSE A multifamily residential building containing three or more dwellings characterized by a linear arrangement of the units along one axis and at approximately the same grade, each with its own exclusive entrance and each with two or more floor levels above grade, with a maximum of seven (7) units per building. III Article IV, Zoning Provisions, Section 25-21, Establishment of Zones, is hereby amended to add "Chestnut Street / 2nd & 3rd Avenue Overlay Zone" as follows: 25-21 ESTABLISHMENT OF ZONES. For the purposes of this chapter, the Borough of Farmingdale is divided into nine (9) twelve (12) zones known as: R-6 - Single Family Residential; R-7.5 - Medium Density Single-Family Residential; R-10 -Medium Density Single-Family Residential; R-15 - Medium Density Single-Family Residential; R-40 - Low Density Single-Family Residential; VC - Village Commercial; GC - General Commercial; LI -Light Industrial; AH-1-Overlay - Affordable Housing -1-Overlay; MF - Multi-Family Residential; MF-AH - Multi-Family Affordable Housing Overlay; Chestnut Street / 2nd & 3rd Avenue Overlay Zone IV Article IV, Zoning Provisions, Section 25-22, Official Zoning Map, is hereby amended to add the Chestnut Street / 2nd and 3rd Avenue Overlay Zone comprised of: Block 22, portion of lot 1; Block 23, lot 1 and 2; Block 28, lots 1, 2.01, 4, 5 & 9; Block 29, lot 1; block 30, lot 1; block 31, lot 1, 2 & 3; block 38, lot 1. The area is delineated on the attached map entitled "Proposed Zoning Map Revision" dated March 25, 2025. Following adoption by the Borough Council, Section 25-22 is hereby amended to add this Ordinance number and the date of adoption to the list of Zoning Map Amendments. V Article IV, Zoning provisions, Section 25-34-B, "Chestnut Street / 2nd and 3rd Avenue Overlay Zone", is hereby added as follows: 25-34-B. CHESTNUT STREET / 2ND & 3RD AVENUE OVERLAY ZONE 25-34-B.1 Purpose. The purpose of the Chestnut Street / 2nd and 3rd Avenue Overlay Zone is intended for the development of townhouse dwellings of which 20 percent is restricted to occupancy by households of very low, low and moderate income persons. Affordable housing dwelling shall be integrated with and be indistinguishable in outward appearance from the market-rate housing. 25-34-B.2 Applicability. The use, bulk, design, and performance standards of the Chestnut Street / 2nd and 3rd Avenue Overlay Zone shall supersede all other provisions of the Farmingdale Land Development Regulations. However, where the regulations and standards of the overlay zone are silent, the standards of the Land Development Regulations shall apply. 25-34-B.3 Permitted Uses and Structures. Principal Uses Townhouse and stacked townhouse dwellings including an inclusionary component of very-low, low, and moderate-income housing units in accordance with Affordable Housing Regulations of Article XXVI. Accessory UsesPrivate garages for automobiles, Patios, Fences, and walls Conservation areas, recreation, open space and public purposes usesStormwater management and other utilitiesStructures for maintenance and storage of maintenance equipment 25-34-B.4 Area and Bulk Requirements Maximum density – 14 dwelling units/acre Maximum height – 35 feet / 2 ½ storiesMinimum front yard setback - 20 feetMinimum rear yard setback – 25 feetMinimum side yard setback - 15 feetMaximum number of units per structure – 7Minimum distance between buildings – side-to-side – 30 feetMinimum distance between buildings – back-to-back – 40 feetMinimum buffer to railroad right-of-way – 30 feetMaximum lot coverageBuilding - 50% of lot areaImpervious - 70% of lot area 25-34-B.5 Other Provisions and Requirements. Off-street parking is required subject to the requirements of Section 25-44 except for off-street parking minimum spaces.Off-street parking minimum spaces is subject to the requirements of the New Jersey Residential Site Improvement Standards (R.S.I.S) (N.J.A.C. 5:21) Landscaping is required subject to requirements of Section 25-46.Sidewalks shall be provided in accordance with Section 25-56.9. VI All Ordinances and parts of Ordinances inconsistent herewith are hereby repealed. VII If any section, subparagraph, sentence, clause, or phase of this Ordinance shall be held to be invalid, such decision shall not invalidate any remaining portion of this Ordinance. VIII Pursuant to the provisions of N.J.S.A. 40:69A-181 (b), this Ordinance shall take effect twenty (20) days after its final passage by the Borough Council, approval by the Mayor where such approval is required by law, filing with the Monmouth County Planning Board, and in accordance with any other laws which may be applicable. A copy of this Ordinance shall be filed with the Borough of Farmingdale Tax Assessor, Zoning Officer, Planning Board/Zoning Board of Adjustment, Planner and Engineer; and the Monmouth County Planning Board.
