Notice of Pending Application for Miscellaneous Structure
Daniel Higginbotham has applied to the Department of Natural Resources for a miscellaneous structure permit. The project is located on the Eau Claire River in the NW 1/4, NW 1/4, Section 08, Township 28 North, Range 08 East, Town of Weston, Marathon County.
The proposed miscellaneous structure involves using sheet piling associated with fill impacting 750 square feet on the bed of the Eau Claire River for trail connectivity that is not only seen as a benefit to the bicycling/ pedestrian genre, but also benefits peddle/paddle recreation on the Eau Claire River, bird watching within the 300 Acre Eau Claire River flowage and general outdoor education and recreation within the Wausau Metro Urban Area. It is important to note how this recreational trail network development is proposed to not only tie together many regions of the state but how its occurring in the midst of the urban area, providing nearby outdoor opportunities to tens of thousands of people.
The Department will review the proposal provided by the applicant and any information from public comments and the public informational hearing. The Department will determine whether the proposal complies with ss. 1.11, 30.12 and s. 30.208, Wis. Stats., and chs. NR 150 and NR 329, Wis. Adm. Code, and ensure that the required mitigation meets the standards in s. 281.36(3r), Wis. Stats., if the project impacts wetlands.
The Department has made a tentative determination that it will modify the permit for the proposed activity.

Comments must be submitted or postmarked no later than 30 days after the date on which the Department first publishes the notice on our Internet website.
If you would like to request a public informational hearing, the request must be submitted or postmarked within 20 days after the date on which the Department first publishes the notice on our Internet website. A request for hearing must include the docket number or applicant name and specify the issues that the party desires to be addressed at the informational hearing. If no hearing is requested, the Department will issue its decision without a hearing. If a hearing is held, comments must be submitted or postmarked no later than 10 days following the hearing date.
The final decision may be appealed as indicated in the decision document.
