Notice of Pending Application for Miscellaneous Structures
Chris Kubacki, on behalf of Milwaukee County Parks, and Mark Mittag, on behalf of the Milwaukee Metropolitan Sewerage District, have applied to the Department of Natural Resources permits to install miscellaneous structures on Honey Creek. The project is located at McCarty Park in the SW 1/4 of NE 1/4, Section 09, Township 06, Range 21 E, City of West Allis, Milwaukee County.
This project proposes to reconstruct the inlet to the tunnel to reduce the risk of flooding from debris accumulation. A new, tiered, grate structure will be constructed south of the present grate. The new structure will incorporate a new headwall, new wingwalls, and reconstruction of concrete lining. The project proposal also includes a series of structures in the channel upstream of the new grate structure for the purpose of intercepting and capturing larger debris during a storm event before it can collect on the grate and clog the grate. The intent of this system is to better manage debris to reduce the risk of flooding from debris accumulation at the tunnel inlet. The project is proposed to be constructed in the fall of 2026.
The Department will review the proposal provided by the applicant and any information from public comments and the public informational hearing. The Department will determine whether the proposal complies with ss. 1.11, 30.12(3m), and s. 30.208, Stats., and ch. NR 150, Wis. Adm. Code.
The Department has made a tentative determination that it will issue the permits for the proposed structures.

Comments must be submitted or postmarked no later than 30 days after 3/9/2026.
If you would like to request a public informational hearing, the request must be submitted or postmarked within 20 days after 3/9/2026. A request for hearing must include the docket number or applicant name and specify the issues that the party desires to be addressed at the informational hearing. If no hearing is requested, the Department will issue its decision without a hearing. If a hearing is held, comments must be submitted or postmarked no later than 10 days following the hearing date.
The final decision may be appealed as indicated in the decision document.
