TOWNSHIP OF MILLBURN
ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that Triple One Holdings, LLC (the "Applicant") has filed an application CAL#4025-25 for preliminary and final major site plan approval with use and bulk variance relief with the Township of Millburn Zoning Board of Adjustment (the "Board") for property located at 44 Essex Street, Township of Millburn, New Jersey (the "Property"), which is designated as Block 703, Lot 9 on the Tax Map of the Township of Millburn (the "Township"). The Property is located in the B-4 Zone District.
The Property is currently developed with a one-story building of approximately 2,018 square feet known as Sakura Japanese restaurant with a supporting parking lot of ten (10) spaces. The Applicant is seeking preliminary and final major site plan approval with bulk variance approvals from the Board to construct a 4-unit multi-family apartment building over the existing restaurant with alterations to the existing parking lot. The first residential floor will be approximately 4,810 total square feet and consist of two 2-bedroom-plus-den units. The second residential floor will also be approximately 4,810 total square feet and consist of two 3-bedroom units. Multifamily housing developments in combination with restaurant use are permitted in the B-4 Zone pursuant to §DRZ.606.7b.3.
The Applicant is seeking the following variance relief in conjunction with its application pursuant to N.J.S.A. 40:55D-70(d)(5) and the Millburn Code:
§606.7.h.1. – Maximum development yield for multifamily housing developments shall not exceed a density of 25 dwelling units per acre. The property permits 3.535 units, however the application proposes 4 units. A D(5) density variance is therefore required.
The Applicant is seeking the following bulk variance relief pursuant to N.J.S.A. 40:55D-70(c)(1) and/or (c)(2) from the provisions of the Millburn Code:
§607.2- Minimum Parking Requirements - A parking variance is requested. The ordinance requires 16 spaces for the restaurant use and there are 10 spaces existing. With the proposed residential use, the total number of spaces required is 24. This application proposes 8 spaces (including 1 EV credit). Applicant seeks an expansion of an existing non-conforming condition.
§606.7(E)3 – Maximum Building Coverage – 90% coverage is permitted; 37.44% existing; 97.85% proposed.
§607.1(B) – Minimum Loading Requirements – One space is required by ordinance for the restaurant refuse loading; no loading space is proposed.
The Applicant is seeking the following design waivers pursuant to N.J.S.A. 40:55D-51 and the
Millburn Code:
§516.A – Parking Space Size – 9' x 19' is required; 9' x 18' is proposed.
§516.C – ADA Parking Space Size – 12' x 20' is required; 8' x 18' is proposed.
In addition, to the extent deemed necessary, the Applicant is also requesting "c" bulk variance relief for the following pre-existing non-conforming site conditions:
§607.7(E).2 – Variance for Existing Non-Conforming Minimum Lot Size – 0.75 acres required; 0.14 acres existing and proposed (no change).
§609.10 – Variance for Existing Non-Conforming Wall Graphic Sign Height (existing "Sakura" sign facing Essex Street) – 2' permitted; 2.17' existing and proposed (no change).
In addition to the above approvals, the Applicant requests that the application be deemed amended to include, and that the Board grant, any additional approvals, variances, exceptions, or waivers determined to be necessary or desirable in the review and processing of this application, whether requested by the Applicant, the Board or otherwise.
A public hearing on said application will be held by the Board on March 16, 2026, at 7:00 p.m. in the Millburn Board of Education Center, 434 Millburn Avenue, Millburn, NJ 07041, at which time any interested party may appear, if they so desire, either in person or by attorney ask questions, cross examine witnesses and present testimony and any comments they may have with respect to this application. The Application may be carried to future hearings without any additional public notice.
All maps and documents relating to this application are on file with the Township's administrative officer in the office of the Board Secretary, 22 East Willow Street, Millburn, New Jersey 07041, and may be inspected by the public ten (10) days prior to the hearing between the hours of 8:30 a.m. to 3:30 p.m., Mondays through Fridays (except holidays). Application documents can also be viewed on the Township's website Zoning Board page (https://twp.millburn.nj.us) as a courtesy only.
This notice is being sent to you by the Applicant as required by the State of New Jersey's Municipal Land Use Law (N.J.S.A. 40:55D-10 and 12).
