Notice of Public Hearing by the Town of Zionsville Board of Zoning Appeals
Notice is hereby given of a Public Hearing to be held by the Town of Zionsville Board of Zoning Appeals on Wednesday, November 5, 2025, at 6:30 p.m. in the Zionsville Town Hall, 1100 West Oak Street, Zionsville, Indiana 46077 to consider the following Petition:
Petition # 2025-34-DSV, filed for Timothy J. Walter, requests Board of Zoning Appeals Approval for a Variance of Development Standards to provide for or permit:
Development Standards Variance pursuant to Section 194.169, Table 16 to exceed the maximum square footage allowed for a freestanding sign in the Rural Single and Two-Family Residential (R-3) zoning district.
The property involved is commonly known as: East CR 200 South, Zionsville, IN 46077 and is legally described as:
Part of the Northeast and Northwest Quarters of Section 13, Township 18 North, Range 2 East of the Second Principal Meridian, Boone County, Indiana, being that 160.919-acre tract of land shown on the ALTA/NSPS Land Title Survey dated May 6, 2021, as last revised, by Michael J. Smith, PS #LS20500025 of American Structurepoint, Inc. under project number 2020.02000, more particularly described as follows:
BEGINNING at a Harrison Monument at the northwest corner of said Northeast Quarter; thence North 88 degrees 36 minutes 08 seconds East 664.46 feet along the north line of said Northeast Quarter (the basis of bearings is the Indiana Geospatial Coordinate System, Boone Zone) to a mag nail set at the northeast corner of the West Half of the West Half of said Northeast Quarter; thence South 00 degrees 13 minutes 41 seconds East 2,637.50 feet along the east line of said Half-Half Quarter Section to the southeast corner thereof; thence South 88 degrees 34 minutes 12 seconds West 663.31 feet along the south line of said Northeast Quarter to a 5/8-inch diameter rebar with a cap stamped "ASI FIRM #0094" set flush (hereafter referred to as "set rebar") at the southeast corner of said Northwest Quarter; thence South 88 degrees 34 minutes 12 seconds West 2,660.45 feet along the south line of said Northwest Quarter to a "Boone County" aluminum disk at the southwest corner thereof; thence North 00 degrees 08 minutes 44 seconds West 1,319.38 feet along the west line of said Northwest Quarter to a set rebar at the southwest corner of the Northwest Quarter of said Northwest Quarter; thence North 88 degrees 34 minutes 43 seconds East 1,328.98 feet along the south line of said Quarter-Quarter Section to a rebar set at the southeast corner thereof; thence North 00 degrees 11 minutes 58 seconds West 1,319.15 feet along the east line of said Quarter-Quarter Section to a mag nail set at the northeast corner thereof; thence North 88 degrees 35 minutes 14 seconds East 1,327.74 feet along the north line of said Northwest Quarter to the POINT OF BEGINNING. Containing 160.919 acres, more or less.
A copy of the Petition for Board of Zoning Appeal Approval, and all plans pertaining thereto are on file and may be examined prior to the Public Hearing from 8:00 a.m. to 4:00 p.m. Monday through Friday, except for Holidays, in the Planning & Building Department in the Zionsville Town Hall, 1100 West Oak Street, Zionsville, Indiana, 46077. Written comments in support of or in opposition of the Petition that are filed with the Secretary of the Town of Zionsville Board of Zoning Appeals prior to the Public Hearing will be considered. The Public Hearing is open to the public. Oral comments to this Petition will be heard at the Public Hearing. The Public Hearing may be continued from time to time as may be found necessary.
Further, and as allowed by the laws of the State of Indiana, members of the public will be afforded the opportunity to attend the Board of Zoning Appeals Public Meetings via a form(s) of electronic communication IF indicated in the Agenda (as amended from time to time) associated with the Board of Zoning Appeals Meeting.
