NOTICE OF SALE
STATE OF NEW YORK, SUPREME COURT, COUNTY OF BROOME,
MANUFACTURERS AND TRADERS TRUST COMPANY, Plaintiff, vs. JUNE E. RICE, individually, and as surviving spouse of James C. Rice, et al., Defendants, Index No. EFCA2024001403. Pursuant to a judgment of foreclosure and sale granted and entered in the above-entitled action in the Broome County Clerk's Office on October 7, 2025, I, the undersigned Referee in said judgment named, will sell at public auction in the basement of the Broome County Court House, 92 Court Street, City of Binghamton, in the County of Broome, State of New York, on December 2, 2025 at 1:30 o'clock in the afternoon of that day the premises described as follows:
ALL THAT TRACT OR PARCEL OF LAND, situate in the Village of Johnson City, Town of Union, County of Broome and State of New York, and being Lot #417 as laid down on a map of Parkview Additions recorded in Broome County Clerk's Office in Book #3 of Maps at pages 68 and 69. Said lot is situate on the west side of Zoa Avenue and is forty (40) feet wide front and rear and one hundred and thirty-four (134) feet deep.
Being the same premises conveyed to the parties of the first part from Mary Orzell and Josephine Sedor, as Executors of the last Will and Testament of Susan Plavka, by executor's deed dated July 2, 1984, and recorded in the Broome County Clerk's Office on July 2, 1984, in Book 1410 of Deeds at page 46.
Together with the appurtenances and all the estate and rights of the parties of the first part in and to said premises.
Being the same premises conveyed to James C. Rice and June E. Rice, husband and wife, as tenants by the entirety, from Ray M. Shapinas and Evelyn L. Shapinas by deed dated 12/22/2005 and recorded on 12/22/2005, at Book 2134, Page 89, in Broome County, NY.

Subject to easements, covenants and restrictions of record, if any.
The mortgaged property is sold in one parcel in "as is" physical order and condition, subject to any condition that an inspection of the property would disclose; any facts that an accurate survey of the property would show; any covenants, restrictions, declarations, reservations, easements, right of way, and public utility agreements of record, if any; any building and zoning ordinances of the municipality in which the mortgaged property is located and possible violations of same; any rights of tenants or persons in possession of the subject property; prior liens of record, if any, except those liens addressed in RPAPL §1354; any equity of redemption of the United States of America to redeem the property within 120 days from the date of sale; and any rights pursuant to CPLR §317, §2003 and §5015, or any appeal of the underlying action or additional litigation brought by any defendant or its successor or assignee contesting the validity of this foreclosure.
The auction shall be conducted in accordance with the then applicable Sixth Judicial District Foreclosure Auction Plan and the COVID-19 Health Emergency Rules of Broome County.
