NOTICE OF SALE
SUPREME COURT OF THE STATE OF NEW YORK COUNTY OF WESTCHESTER
THE WOODS III IN WESTCHESTER HOMEOWNERS ASSOCIATION, INC. and THE BOARD OF MANAGERS OF THE WOODS III IN WESTCHESTER CONDOMINIUM II, Plaintiffs-against- DEBRA A. NIELSEN, CAPITAL ONE N.A., JOHN DOE NO. I through JOHN DOE NO. 6, etc., Defendants.
Pursuant to the Amended Order Confirming Revised Referee's Report of Amount Due and Judgment of Foreclosure and Sale duly entered May 29, 2026, I, the undersigned Referee will sell at public auction at the Lobby of the Westchester County Courthouse, 111 Dr. Martin Luther King, Jr., Boulevard, White Plains, New York 10601 on the 21st day of July, 2026 at 10:30 A.M. all that certain piece, plot or parcel of land situate, with the building and improvements thereon erected, said premises designated and described as Unit 20-6 in Building known as No. 20 (hereinafter the "Unit") in the property known as The Woods III In Westchester Condominium II, located in the City of Peekskill, County of Westchester, State of New York, said Unit known as 22 Bleakley Drive, Peekskill, New York 10566, together with the Unit's appurtenant undivided interest in the Common Elements, as set forth in the Declaration of Condominium and By Laws, as recorded in the Office of the Westchester County Clerk and as Section 33.7, Block 3, Lot 13./2006 on the tax assessment map of the City of Peekskill, County of Westchester, State of New York, as more particularly described in the Amended Judgment of Foreclosure and Sale entered on May 29, 2026. The premises will be sold in one parcel only, as a single condominium unit, in accordance with the Amended Judgment of Foreclosure and Sale.
Approximate amount of judgment $79,802.25, plus interest and costs. Premises will be sold subject to provisions of filed Amended Order Confirming Revised Referee's Report and Judgment of Foreclosure and Sale Index No. 75100/2024 and Terms of Sale.
On March 13, 2026, the City of Peekskill commenced an in rem tax foreclosure proceeding pursuant to Article 11 of the Real Property Tax Law, under Westchester County Index No. 59412/2026. The subject premises in the referenced action is identified as one of the parcels included in that municipal foreclosure proceeding. The City's Notice of Petition sets a redemption deadline of on or about September 20, 2026, after which the City may seek a final judgment vesting absolute title under RPTL § 1136. The sale is subject to the outstanding taxes and purchaser will be responsible for payment of all such taxes which accrued prior to the sale.
The aforementioned auction will be conducted in accordance with the WESTCHESTER County COVID-19 Mitigation Protocols and as such all persons must comply with social distancing, wearing masks and screening practices in effect at the time of this foreclosure sale.
