Notice of Sale Under Power in Security Deed

Under and by virtue of the Power of Sale contained in the Deed to Secure Debt, Assignment of Leases and Rents, and Security Agreement from SFR5, LLC, a Georgia limited liability company to PIC FUND I, LLC, a Wyoming limited liability company, dated March 10, 2025, and recorded in Deed Book 15562, Page 120, in the offices of the Clerk of the Superior Court of Columbia County, Georgia (as same may have been modified from time to time, collectively the "Security Deed"), the undersigned will sell at public outcry to the highest and best bidder for cash before the door of the Courthouse of Columbia County, Georgia, during the legal hours of sale, on the first Tuesday in April, 2026, the following described real property, to wit:
ALL THAT LOT OR PARCEL OF LAND WITH IMPROVEMENTS THEREON, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF COLUMBIA, BEING SHOWN AND DESIGNATED AS CONSISTING OF 2.86 ACRES, MORE OR LESS, ON A PLAT RECORDED IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF COLUMBIA COUNTY, GEORGIA IN PLAT BOOK 9, PAGE 286; REFERENCE BEING MADE TO SAID PLAT FOR A MORE COMPLETE AND ACCURATE DESCRIPTION AS TO METES, BOUNDS AND LOCATION OF SAID PROPERTY.
ALSO INCLUDED IN THIS CONVEYANCE IS A NOT-EXCLUSIVE PERPETUAL EASEMENT FOR THE PURPOSE OF INGRESS AND EGRESS TO FROM THE SUBJECT PROPERTY TO AND FROM THE 50 FOOT ROAD RIGHT OF WAY WHICH TERMINATES AT THE SOUTHWESTERN INTERSECTION OF TRACT B AND D AS SHOWN ON A PLAT RECORDED IN AFORESAID CLERK'S OFFICE IN PLAT BOOK 4, PAGE 83. SAID EASEMENT IS 50 FEET IN WIDTH AND THE SOUTHERNMOST BOUNDARY LINE OF SAID EASEMENT IS ALSO THE SOUTHERNMOST BOUNDARY LINE OF TRACT D AS SHOWN THE LAST DESCRIBED TRACT.
SAID PROPERTY IS CONVEYED SUBJECT TO A NON-EXCLUSIVE AND PREPETUAL EASEMENT FOR INGRESS AND EGRESS 50 FEET IN WIDTH WHICH EASEMENT IS EASTERLY EXTENSION THROUGH THE PROPERTY HEREBY CONVEYED OF THE EASEMENT DESCRIBED IN THE PRECEDING PARAGRAPH.
SAID PROPERTY IS CONVEYED SUBJECT TO AND WITH NOTICE OF THE FOLLOWING MATTERS: A) DRAINAGE EASEMENTS, BUILDING SETBACK LINES, AND ALL OTHER MATTERS SHOWN ON A PLAT RECORD; 2) GENERAL UNTILITY EASEMENTS AND ROAD RIGHT-OF-WAY GRANTS AND EASEMENTS.
SAID PROPERTY IS HEREBY CONVEYED SUBJECT TO ANY AND ALL OTHER EASEMENTS, RESTRICTIONS AND RIGHT OF WAY OF RECORD IN AFORESAID CLERK'S OFFICE.
PROPERTY BEING MORE COMMONLY KNOWN AS: 871 POLATTY DRIVE, GROVETOWN, GEORGIA 30813 [TAX PARCEL ID # 063 143]
In addition, under and by virtue of the power of sale contained in the Security Deed, the undersigned will also sell at public outcry to the highest bidder for cash before the door of the Courthouse of Columbia County, Georgia, immediately following the sale of the above-described real property, the following described personal property owned by SFR5, LLC, or its successors-in-title and secured by the Security Deed, to wit:
All personal property described in and subject to the Security Deed, which is hereby incorporated by this reference.
Less and except any fixtures subject to the security interest on the above-described real property.
The debt secured by the Security Deed is evidenced by a Promissory Note, dated March 10, 2025 from SFR5, LLC to PIC FUND I, LLC in the original principal amount of $220,250.00 (as same may have been further modified, renewed or amended, collectively the "Note"); plus interest from date on the unpaid balance until paid, and other indebtedness.
Default has occurred and continues under the terms of the Note and Security Deed by reason of, among other possible events of default, the nonpayment when due of the indebtedness evidenced by the Note and secured by the Security Deed and the failure to comply with the terms and conditions of the Note and Security Deed. By reason of this default, the Security Deed has been declared foreclosable according to its terms.
The above-described real property will be sold to the highest and best bidder for cash as the property of SFR5, LLC, the proceeds to be applied to the payment of said indebtedness, attorneys' fees, and the lawful expenses of said sale, all as provided in the Note and Security Deed. The sale shall be subject to the following: all outstanding ad valorem taxes and/or assessments, if any; possible redemptive rights of the Internal Revenue Service, if any; and all prior assessments, easements, restrictions or matters of record.
To the best of the undersigned's knowledge and belief, the real property is presently owned by SFR5, LLC.
To the best of the undersigned's knowledge and belief, the party in possession of the real property is SFR5, LLC, and tenants holding under it.
All personal property will be sold in one lot to the highest and best bidder for cash as the property of SFR5, LLC, or its successors-in-title, on an "as is, where is" basis and without representation, warranty or recourse, express or implied, of the undersigned, and subject to all matters of record affecting said personal property, the proceeds to be applied to the payment of said indebtedness, attorneys' fees and the lawful expenses of said sale, all as provided in the Security Deed.
