Matthew J. Ellis, Substitute Trustee, as recorded in ORBV 2295, Page 34, on May 1, 2023, in the Register's Office for Montgomery County, Tennessee, gives notice that the obligation of Gregory Neil Griffy to Matthew J. Ellis, Substitute Trustee for Gateway Financial Services, Inc., secured by a Deed of Trust of record in ORBV 2030, Page 867, Register's Office for Montgomery County, Tennessee, is in default.
Pursuant to the authority of said Deed of Trust, the following described realty will be sold at public auction to the highest bidder on the 26th day of March, 2026, at 11:30 a.m., prevailing time at the Montgomery County Courthouse, One Millennium Plaza, Clarksville, Tennessee 37040.
The realty involved is located in the Eighth (8th) Civil District of Montgomery County, Tennessee, and is designated as:
SITUATED in the Eighth Civil District of Montgomery County, Tennessee, and bounded and described as follows:
Beginning at an iron pin located in the northeast right of way of York Road (York Road having a 50 foot right of way), said beginning point being further described as 1.75 miles west of the intersection of Liberty Church Road; thence from said beginning point North 27 degrees 49 minutes 20 seconds West 150.00 feet to an iron pin; thence south 52 degrees 32 minutes 05 seconds west 176.27 feet to an iron pin; thence south 27 degrees 58 minutes 43 seconds east 150.00 feet to an iron pin in the northwest right of way of York Road; thence continuing along the west right of way of York Road North 46 degrees 45 minutes 02 seconds East 66.56 feet to an iron pin; thence North 56 degrees 00 minutes 00 seconds East 109.85 feet to an iron pin according to the survey of Young Land Surveying dated December 20, 1989, Job No. 89-475.
This property is further identified as tax parcel #069-065.01, in the Tax Assessor's Office for Montgomery County, Tennessee.
BEING the same property conveyed to Neil Griffy (a/k/a Gregory Neil Griffy) by deed of Cumberland Bank & Trust dated March 29, 2017, of record in the Register's Office for Montgomery County, Tennessee in ORBV 2030, Page 865, on November 12, 2020.
Said realty is commonly known as: 1979 York Road, Woodlawn, Tennessee 37191, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description herein shall control.
For source of title: This being the same property conveyed to Neil Griffy (a/k/a Gregory Neil Griffy) by deed of Cumberland Bank & Trust dated March 29, 2017, of record in the Register's Office for Montgomery County, Tennessee in ORBV 2030, Page 865 on November 12, 2020.
The terms of the sale shall be cash, and the realty will be sold, in bar of all equities of redemption, homestead, dower, and all other rights of homestead exemption in, and equitable and statutory redemption of the property, and all marital rights of any type, nature and kind, all of which were waived in the referenced Deed of Trust, and all of such rights of Gregory Neil Griffy and those claiming through him, subject to any (1) accrued taxes; and (2) all matters that an accurate and current survey would disclose.
OTHER INTERESTED PARTIES - The aforementioned real property is further subject to a Judgment entered in favor of First Financial Bank, Plaintiff, against Gregory N. Griffy, Defendant, by the Montgomery County General Sessions Court, of record in ORBV 2217, page 2547, Register's Office for Montgomery County, Tennessee; and further subject to a Judgment entered in favor of Jeff Sayle, J&K Enterprises, Plaintiff, against Neil Griffy, Defendant, by the Montgomery County General Sessions Court, of record in ORBV 2398, page 1630, ROMCT.
The right is reserved to adjourn the date of the sale to another day, time and place certain without further publication, upon announcement at the time and place for the sale set forth above.
