Notice of Successor Trustee's Sale
WHEREAS, Jamison H. Seibert and wife, Christy L. Seibert (collectively, the "Grantor") executed a Deed of Trust dated March 29, 2018, to Judy S. Wells, as Trustee, to secure the payment of a note of even date to CapStar Bank, n/k/a Old National Bank (the "Holder"), said Deed of Trust appearing of record as Instrument Number 20180409-0033175, in the Register's Office for Davidson County, Tennessee, as modified by instrument of record as Instrument No.20181217-0122345, corrected in Instrument No. 20190114-0003381 (the "Deed of Trust"); and
WHEREAS, default has occurred by Grantor's failure to comply with the terms and conditions of the Deed of Trust, and the Indebtedness has been declared due and payable as provided in the Deed of Trust, and the Indebtedness has not been paid; and
WHEREAS, Lender has demanded that the Property be advertised and sold in satisfaction of the Indebtedness and the costs of foreclosure in accordance with the terms of the Deed of Trust; and
WHEREAS, the undersigned, Erika R. Barnes, has been duly appointed as Successor Trustee, in place and stead of Judy S. Wells and any and all prior trustees, said appointment being of record as Instrument Number 20260416-0031199, in said Register's Office.
NOW, THEREFORE, notice is hereby given that I, Erika R. Barnes, or my agent, Successor Trustee, pursuant to the power, duty and authority vested in and imposed upon me in the Deed of Trust, Friday, May 22, 2026, at 10:15 a.m., prevailing Central Time, outside the south side entrance of the Davidson County Courthouse, located at 1 Public Square, Nashville, Davidson County, Tennessee, offer for sale to the highest and best bidder, for immediately available funds, free from all free from equity of redemption, and any statutory or common law right of redemption, homestead, dower, marital share, and all other exemptions, all of which are expressly waived in the Deed of Trust. the real property situated in Davidson County, Tennessee, described as follows, together with any and all improvements, tenements, hereditaments and appurtenances, all easements serving or benefiting the property, and any or all fixtures and improvements now or hereafter attached to the property (collectively, the "Property"):
Land in Davidson County, Tennessee, being known as Tract 8 on Cantarutti Road, described as follows:
Beginning at a point 1,850 feet from the southerly margin of Clarksville Highway, thence around a curve 152 feet with the margin of Cantarutti Road to an iron pin; thence S 12 deg. 30' W, 197 feet with the margin of said road to an iron pin; thence S 17 deg. 30' E, 610 feet to an iron pin; thence W. 46 deg. 00' W, 755 feet to the point of beginning.
Being the same property conveyed to Billy D. Garrett Et ux Peggy Sue Garrett, by Warranty Deed from Howard B. Moore Et ux Margie M. Moore, dated December 21, 1971, of record in Book 4563, page 519, Register's Office for Davidson County, Tennessee. Also being the same property conveyed to Peggy Sue Boner Garrett by Quitclaim Deed from Billy Dean Garrett, Sr., dated September 23, 1987, of record in Book 7476, page 804, Register's Office for Davidson County, Tennessee. Also being the same property conveyed to Peggy Sue Boner Garrett and Christy Seibert, as joint tenants with right of survivorship, by Quitclaim Deed from Peggy Sue Boner Garrett, dated May 22, 1997, of record in Book 10468, page 74, Register's Office for Davidson County, Tennessee. Also being the same property conveyed to Peggy Sue Boner Garrett, single, and Jamison H. Seibert and wife, Christy L. Seibert, by Quitclaim Deed from Peggy Sue Boner Garrett, dated September 19, 2003, of record in Instrument No. 20030925-0142301, Register's Office for Davidson County, Tennessee. Also being the same property conveyed to Peggy Sue Boner Garrett, single, by Quitclaim Deed from Peggy Sue Boner, Garrett, single, Jamison H. Seibert and wife, Christy L. Seibert, dated September 30, 2004, of record in Instrument No. 20041005-0119485, corrected in Instrument No. 20170131-0010458, Register's Office for Davidson County, Tennessee. Also being the same property conveyed to Jamison H. Seibert and wife, Christy L. Seibert, as joint tenants in common, by Warranty Deed from Peggy Sue Boner Garrett, unmarried, dated February 28, 2008, of record in Instrument No. 20080311-0024466, Register's Office for Davidson County, Tennessee. AND being the same property conveyed to Jamison Devin Seibert by Quitclaim Deed from Jamison H. Seibert, dated July 16, 2025, of record in Instrument 20250801-0060984, Register's Office for Davidson County, Tennessee.
The full legal description of the Property can be found in the Deed of Trust. The street address of the Property is believed to be 3891 Cantarutti Road, Joelton, TN 37080, but such address is not part of the legal description. The Map and Parcel number of the Property is believed to be Parcel 029-00-0-192.00, but such Map and Parcel number is not part of the legal description. In the event of any discrepancy, the legal description in the Deed of Trust shall control.
In accordance with Tennessee Code Annotated Section 47-9-604, the sale of the Real Property will be combined with a sale of any and all personal property covered by or described in the Deed of Trust which under applicable law may be subject to a security interest pursuant to the Uniform Commercial Code as enacted in the State of Tennessee, including, without limitation, any and all proceeds hereof (collectively, the "Personal Property").
As used herein, the "Property" shall mean the Real Property and the Personal Property.
A review of the records at said Register's Office disclosed that the Property may be subject to certain matters set forth below and that the persons named below may be interested parties, along with the persons named in the first paragraph of this Notice of Successor Trustee's Sale:
1. Any and all unpaid ad valorem taxes payable to Davidson County, Tennessee (plus penalty and interest, if any) that may be a lien against the Property.
2. Deed of Trust executed by Jamison H. Seibert and Christy L. Seibert, husband and wife, to Homestead Title & Escrow, LLC, Trustee, to secure to Farmington Mortgage, a Division of CapStar Bank, an indebtedness in the amount of $143,467.00, of record in Instrument No. 20170131-0010459, Register's Office for Davidson County, Tennessee dated January 26, 2017. This Deed of Trust was assigned to Lakeview Loan Servicing, LLC, by instrument of record in Instrument No. 20210602-0073605, Register's Office for Davidson County, Tennessee.
3. Deed of Trust executed by Jamison H. Seibert and wife, Christy L. Seibert, to Judy S. Wells, Trustee, to secure to CapStar Bank an indebtedness in the amount of $25,000.00, of record in Instrument No. 20180409-0033175, Register's Office for Davidson County, Tennessee dated March 29, 2018. This Deed of Trust was modified by instrument of record in Instrument No. 20181217-0122345, corrected in Instrument No. 20190114-0003381, Register's Office for Davidson County, Tennessee.
4. Deed of Trust executed by Jamison H. Seibert and Christy L. Seibert, husband and wife, to Homestead Title and Escrow, LLC, Trustee, to secure to the Secretary of Housing and Urban Development, an indebtedness in the amount of $13,071 .54, of record in Instrument No. 20250911-0072657, Register's Office for Davidson County, Tennessee dated August 28, 21025.
5. Civil Warrant Order filed by C.H.F., Inc., against Jamison Devin Seibert, of record in Instrument No. 20220223-0020335, Register's Office for Davidson County, Tennessee.
6. Abstract of Judgment filed by US Community Credit Union against Jamison D. Seibert, of record in Instrument No. 20220325-0034915, Register's Office for Davidson County, Tennessee.
7. Civil Warrant Order filed by C.H.F., Inc., against Jamison Devin Seibert, of record in Instrument No. 20250811-0063331, Register's Office for Davidson County, Tennessee.
8. Abstract of Judgment filed by US Community Credit Union against Jamison H. Seibert, of record in Instrument No. 20260109-0001969, Register's Office for Davidson County, Tennessee.
9. All other easements and restrictions of record in said Register's Office.
10. Lease and rental contracts not shown of record.
11. Title to that portion of the Property embraced within the bounds of any street, roads or highways.
12. Liens, encumbrances, or claims thereof, which are not shown by the public record.
13. Matters which an accurate survey of the Property might disclose.
The foregoing matters may or may not take priority over the Deed of Trust. To the extent such matters do take priority over the Deed of Trust under applicable law, the sale will be subject to them, and to the extent such matters do not take priority over the Deed of Trust under applicable law, the Property will not remain subject to them after the sale.
The sale will be subject to any and all unpaid ad valorem taxes (plus penalty and interest, if any) that may be a lien against the Property and subject to any and all liens, defects, encumbrances, conveyances, adverse claims and other matters which take priority over the Deed of Trust upon which this foreclosure sale is had, and subject to any statutory rights of redemption not otherwise waived in the Deed of Trust, including the rights of redemption of any governmental agency, state or federal, which have not been waived by such governmental agency, and matters that take priority over the Deed of Trust which an accurate survey of the Property might disclose.
The Property is to be sold AS IS WHERE IS, without representations or warranties of any kind whatsoever, whether express or implied. Without limiting the foregoing, THE PROPERTY IS TO BE SOLD WITHOUT ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR USE OR PURPOSE. Successor Trustee will make no covenant of seisin or warranty of title, express or implied, and will sell and convey her interest in the Property by Successor Trustee's Deed as Successor Trustee only.
The right is reserved to adjourn the day of sale to another day and time certain, without further publication and in accordance with law, upon announcement of said adjournment on the day and time and place of sale set forth above, to sell the Property with or without division if the Property consists of more than one tract or parcel, and to sell to the second highest bidder in the event the highest bidder does not comply with the terms of the sale.
