PUBLIC NOTICE TO ALL PARTIES OF INTEREST AND TO THE GENERAL PUBLIC
This Notice is issued by Dario St. Elmo Davis, a Delaware homeowner who, over nearly twenty (20) years, has uncovered extensive and deeply concerning irregularities in the servicing, transfer, handling, and enforcement of his mortgage by multiple nationally recognized mortgage companies.
During this period, the following entities have—at different times and without consistent documentation—asserted ownership, servicing authority, or enforcement rights over the same mortgage obligation:
First Horizon Home Loan, MetLife Home Loans, Seterus / IBM LBPS, Rushmore Servicing, Rushmore Home Loans, Mr. Cooper (Nationstar), MERS, Fannie Mae, and Citigroup Mortgage Loan Trust.
Based on certified public records, private investigative findings, securitization documents, trust agreements, voluntary lien reports, compliance reviews, and other authenticated evidence, the following issues have been identified:
• Conflicting and contradictory claims of loan ownership and servicing authority
Different companies claimed rights at different times, with no verifiable or lawful chain connecting these transfers.
• Broken, incomplete, or unrecorded chain-of-title
Assignments are missing, contradictory, or appear never to have been executed properly.
• Securitization discrepancies affecting lawful ownership
Evidence suggests the loan may have been securitized into structures inconsistent with representations made by various servicers.
• Long-term servicing inconsistencies and balance irregularities
Including unexplained increases, contradictory payoff amounts, and unclear accounting of payments.
• Patterns suggesting possible systemic issues affecting other Delaware homeowners
The irregularities observed are not typical of a single-loan dispute and raise broader concerns.
• Multiple entities attempting enforcement without verified legal standing
Findings show periods where no entity may have held lawful authority to collect or enforce.
This Notice is published for transparency, public awareness, consumer protection, and accurate documentation.
It does not accuse any party of wrongdoing, but informs the public that significant and material discrepancies exist that warrant examination, clarity, and accountability.
Consumers are encouraged to review their own mortgage documentation.
