ORDINANCE 01-2026
WHEREAS, the District serves the population of the Lake Summerset Subdivision; and
WHEREAS, the Lake Summerset Subdivision does not have an otherwise organized municipal village or city structure; and
WHEREAS, the Lake Summerset residents are required to pay membership dues which support amenities including the lake, beaches and swimming pool; and
WHEREAS, the District provides water and sewer services which are intertwined with the lake, beaches and the swimming pool and other amenities; and
WHEREAS, the District and the Lake Summerset Association have for many years been parties to a Management Agreement pursuant to which services are shared to the financial benefit of both parties; and
WHEREAS, it is in the direct financial interest of the District to cooperate and assist in the collection by Lake Summerset Association of membership fees thereby enabling the Association to better operate and maintain its amenities.
NOW, THEREFORE, BE IT ORDAINED by the Board of Trustees of the Otter Creek Lake Utility District as follows:
1. Commencing immediately, the District authorizes its General Manager to discontinue water and sewer services to residents who fail to pay when due Lake Summerset Association membership fees and other charges, upon prior notice and warning in the manner and form as the District presently proceeds with respect to unpaid water and sewer fees.
2. The Management Agreement between the District and the Association shall be amended to provide for the joint operation of billing for water and sewer fees and Association charges, to the financial benefit and savings of the parties.
3. The District agrees that the Association may, upon discovering through the operation of joint billing services, that District residents are delinquent in water and sewer fees, impose upon such residents the same or substantially similar penalties and restrictions as those presently imposed by the Association on residents who fail to pay membership dues and other charges and liens when due.
4. This Ordinance shall take effect 20 days after publication as required by law.
