ORDINANCE NO. 1141 AN ORDINANCE AMENDING THE CITY OF JOHNSTON REVISED ORDINANCES OF 2007, BY AMENDING CHAPTER 99 SANITARY SEWER, SECTION 99.07 SEWER USER CHARGE BE IT ENACTED by the City Council of the City of Johnston, Iowa: SECTION 1. The "Code of Ordinances" of the City of Johnston, Iowa, is hereby amended by deleting in its entirety Section 99.07 and the following section is substituted in lieu thereof: 99.07 USER CHARGE. 1. Service Availability Charge. Each separate residential unit and each separately billed commercial, industrial or educational premises shall be charged a service availability charge in the amount of: July 1, 2024 $8.36/month January 1, 2026 $9.15/month July 1, 2026 $10.02/month July 1, 2027 $10.97/month July 1, 2028 $12.01/month Commercial condominiums serviced by a single connection shall be billed for each owner of space in the structure. 2. Sewer User Charge. In addition to the service availability charge, each user shall pay a user charge for each 1,000 gallons of water used per month of: July 1, 2024 $7.72/1,000 gallons/month January 1, 2026 $8.45/1,000 gallons/month July 1, 2026 $9.25/1,000 gallons/month July 1, 2027 $10.13/1,000 gallons/month July 1, 2028 $11.09/1,000 gallons/month 3. Sewer User Charge for sewer only customers with no water meter will be based on a volume of 4,633 gallons of water per month. A. Sewer only customers within the City of Johnston: July 1, 2024 $44.15 per month January 1, 2026 $48.30 per month July 1, 2026 $52.88 per month July 1, 2027 $57.90 per month July 1, 2028 $63.39 per month 4. Customers Outside City Limits A. Sewer only customers with water meters located outside the corporate limits of the City which the City has agreed to serve at rates one hundred fifty percent (150%) of the rates provided in 99.07(2) July 1, 2024 $11.58/1,000 gallons/month January 1, 2026 $12.68/1,000 gallons/month July 1, 2026 $13.88/1,000 gallons/month July 1, 2027 $15.20/1,000 gallons/month July 1, 2028 $16.64/1,000 gallons/month B. Sewer only customers with no water meter located outside the corporate limits of the City which the City has agreed to serve at rates one hundred fifty percent (150%) of the rates provided in 99.07 (3.A.): July 1, 2024 $66.23 per month January 1, 2026 $72.45 per month July 1, 2026 $79.32 per month July 1, 2027 $86.85 per month July 1, 2028 $95.09 per month SECTION 2. REPEALER. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed. SECTION 3. SEVERABILITY CLAUSE. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of this ordinance as a whole or any section, provision, or part thereof not adjudged invalid or unconstitutional. SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from an after its final passage, approval and publication as provided by law.
