ORDINANCE NO. 2006-0326 AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, GRANTING A RIGHT-OF-WAY EASEMENT TO ARIZONA PUBLIC SERVICE FOR ELECTRICAL IMPROVEMENTS FOR THE WHITE TANKS ENERGY STORAGE PROJECT. BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows: SECTION 1. An easement is hereby granted to Arizona Public Service Company for electrical improvements for the White Tanks Energy Storage Project substantially in the form and substance attached hereto as Exhibit 1 and incorporated herein by reference, through, over, under and across two parcels of real property generally located on the east side of El Mirage Road and north of Indian School, also known as APN 501-63-996B and APN 501-63-998, as legally described in Exhibit A to the easement form attached hereto as Exhibit 1, for a combined total ± 0.25 acres as legally described and depicted in Exhibit B to the easement form attached hereto as Exhibit 1. SECTION 2. The Mayor, the City Manager, the City Clerk and the City Attorney are hereby authorized and directed to execute all documents and take all steps necessary to carry out the purpose and intent of this Ordinance.
