ORDINANCE NO. 2007-0326 AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, ABANDONING A DRAINAGE EASEMENT, GENERALLY LOCATED SOUTH OF PIONEER STREET AND WEST OF EL MIRAGE ROAD FOR PUBLIC USE. WHEREAS, Article I, Section 3 of the Avondale City Charter authorizes the City of Avondale (the "City") to dispose of its acquired property as the City's interests may require; and WHEREAS, the City acquired a 10-foot public drainage easement generally located south of Pioneer Street and west of El Mirage Road on the northern portion of parcel APN 500-65-144A from Maricopa County, Arizona ("Maricopa County") through Ordinance No. 2004-0226 and recorded by Maricopa County in the Office of the Maricopa County Recorder at Document No. 2026-0096591 on February 19, 2026 (the "Easement"); and WHEREAS, the Council of the City of Avondale (the "City Council") has determined that the Easement, consisting of ± 0.0769 acres of land, is no longer needed and therefore, it is necessary and appropriate to abandon said easement. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows: SECTION 1. The recitals above are hereby incorporated as if fully set forth herein. SECTION 2. The Easement, approximately + 0.0769 acres, as more particularly described and depicted in Exhibit A, attached hereto and incorporated herein by reference, is hereby (i) declared to be no longer necessary for use as a public drainage easement and (ii) abandoned to the surrounding privately-owned parcel. SECTION 3. Upon recordation of this Ordinance in the office of the Maricopa County Recorder, the Easement as a public drainage easement shall be forever extinguished, and all right and title to the real property described therein shall vest in the owner of Maricopa County Parcel No. 500-65-144A. SECTION 4. The Mayor, the City Manager, the City Clerk and the City Attorney are hereby authorized and directed to take all steps and execute all documents necessary to carry out the purpose and intent of this Ordinance.
