ORDINANCE NO. 2021-0726
AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, DECLARING THE DOCUMENT ENTITLED "2024 INTERNATIONAL FIRE CODE" AS A PUBLIC RECORD; DECLARING THE DOCUMENT ENTITLED "AVONDALE AMENDMENTS TO THE 2024 INTERNATIONAL FIRE CODE" AS A PUBLIC RECORD; ADOPTING EACH BY REFERENCE AND AMENDING THE AVONDALE CITY CODE, CHAPTER 10 (FIRE PREVENTION AND PROTECTION), ARTICLE III (FIRE CODE), TO INCLUDE the "2024 international fire code" and the "July 6, 2026 AVONDALE AMENDMENTS to the 2024 INTERNATIONAL FIRE CODE"; providing for SEVERABILITY; providing for PENALTIES.
WHEREAS, the International Code Council produces and provides model codes and standards for use by municipalities in the design, build and compliance process of structures; and
WHEREAS, the International Code Council allows certain municipalities to adopt editions of the international fire codes with local amendments; and
WHEREAS, the City of Avondale has the need to modify certain provisions of the 2024 International Fire Code to accommodate local needs, which local amendments are compiled in the July 6, 2026 Avondale Amendments to the 2024 International Fire Code (the "Avondale Amendments"); and
WHEREAS, the City Council has determined that adoption of the 2024 International Fire Code and the Avondale Amendments is necessary to update the fire regulations, bring uniformity to the fire community and protect the public health, safety, and welfare of the City's residents.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows:
SECTION 1. The recitals above are hereby incorporated as if fully set forth herein.
SECTION 2. That certain document known as the 2024 International Fire Code of which one paper copy and one electronic copy maintained in compliance with Ariz. Rev. Stat. § 44-7041 are on file in the office of the City Clerk and open for public inspection during normal business hours, is hereby declared to be a public record, and said copies are hereby ordered to remain on file with the City Clerk.
SECTION 3. That certain document known as the Avondale Amendments, of which one paper copy and one electronic copy maintained in compliance with Ariz. Rev. Stat. § 44-7041 are on file in the office of the City Clerk and open for public inspection during normal business hours, is hereby declared to be a public record, and said copies are hereby ordered to remain on file with the City Clerk.
SECTION 4. The 2024 International Fire Code is hereby referred to, adopted and made a part of hereof as if fully set out in this Ordinance.
SECTION 5. The Avondale Amendments are hereby referred to, adopted and made a part of hereof as if fully set out in this Ordinance.
SECTION 6. The Avondale City Code, Chapter 10 (Fire Prevention and Protection), Article III (Fire Code), Section 10-40 (Adopted) is hereby deleted in its entirety and replaced with the following:
Section 10-40 – Adoption of codes.
The following code, together with the City of Avondale amendments applicable thereto, are hereby adopted by reference as the Fire Code of the City of Avondale, as if fully set forth herein:
(1) 2024 International Fire Code (IFC). One (1) paper copy and one (1) electronic copy of the adopted International Fire Code and Amendments are on file in the office of the City Clerk of the City of Avondale in compliance with Ariz. Rev. Stat. § 44-7041. These codes regulate the operation, maintenance, use, and conditions hazardous to life, property, and public welfare of buildings, structures, premises, and processes within the corporate limits of the City. It is hereby declared unlawful for any person, firm, or corporation to violate any provision of the Fire Code as adopted by the Council of the City of Avondale.
(2) Adopted Amendments. 2026 Avondale Amendments to the 2024 International Fire Code (07-06-26).
(3) Reference to Amendments. All Avondale-specific amendments to the above codes are hereby incorporated into the adopted codes and have the same force and effect as if fully set forth herein.
SECTION 7. Ordinance No. 2006-0121 and all ordinances or parts of ordinances in conflict with the provisions of this Ordinance or any part of the 2024 International Fire Code or the Avondale Amendments adopted herein are hereby repealed.
SECTION 8. If any section, subsection, sentence, clause, phrase or portion of this Ordinance or any part of the 2024 International Fire Code or the Avondale Amendments is for any reason to be held invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
SECTION 9. Any person found in violation of any provision of the 2024 International Fire Code or the Avondale Amendments may be found guilty of a class one misdemeanor, punishable by a fine not to exceed $2,500, imprisonment for a period not to exceed six months, or by both such fine and imprisonment or issued a civil citation of a $250 base fine for the first violation, $500 base fine for the second violation and $1,000 base fine for a third violation in any twenty-four month period. Each day that a violation or failure to perform continues shall be a separate offense punishable as herein described. After having been found responsible for committing three or more civil infractions of the same code provision in any twenty-four month period, a person is a recidivist offender and may be charged with a class one misdemeanor, punishable as described in the Avondale City Code.
SECTION 10. This ordinance shall take effect 30 days after passing and adoption by Council.
SECTION 11. The Mayor, the City Manager, the City Clerk and the City Attorney are hereby authorized and directed to take all steps necessary to carry out the purpose and intent of this Ordinance.
