ORDINANCE NO. 2024-0726 AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, ACCEPTING THE DEDICATION OF AN EASEMENT FOR A PUBLIC BUS SHELTER GENERALLY LOCATED EAST OF THE SOUTHEAST CORNER OF MCDOWELL ROAD AND 107TH AVENUE FROM PARK 10 SHOPS D & CH, LLC. WHEREAS, Article I, Section 3 of the Avondale City Charter authorizes the City of Avondale (the "City") to acquire real property in fee simple or any lesser interest, inside or outside its corporate limits for any City purpose, when the public convenience requires it and in accordance with the provisions of State law; and WHEREAS, Park 10 Shops D and CH, LLC ("Park 10") is the owner of certain real property identified as Assessor's Parcel Number 102-54-067 generally located east of the southeast corner of McDowell Road and 107th Avenue, in Avondale, Arizona (the "Property"); and WHEREAS, Park 10 desires to dedicate a portion of the Property totaling ± 312 square feet, or 0.01 acres, to the City for use as a bus shelter ("the Easement"); and WHEREAS, the Council of the City of Avondale (the "City Council") desires to accept the Easement necessary for a public bus shelter, generally located east of the southeast corner of McDowell Road and 107th Avenue, in Avondale, Arizona, from Park 10 for public use. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows: SECTION 1. The recitals above are hereby incorporated as if fully set forth herein. SECTION 2. The dedication of real property totaling ± 312 square feet, or 0.01 acres, generally located east of the southeast corner of McDowell Road and 107th Avenue, in Avondale, Arizona, as more particularly described and depicted on Exhibit A of the Bus Shelter Agreement, attached hereto and incorporated herein by reference, is hereby accepted by the City from Park 10 Shops D and CH, LLC for public use. SECTION 3. The Mayor, the City Manager, the City Clerk and the City Attorney are hereby authorized and directed to take all steps and to execute all documents necessary to carry out the purpose and intent of this Ordinance.
