ORDINANCE NO. 2025-0726
AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, ACCEPTING THE DEDICATION OF A NO-BUILD EASEMENT LOCATED ON A PORTION OF THE PARCEL ASSIGNED ASSESSOR'S PARCEL NUMBER 500-26-003B, FROM MARICOPA COUNTY, FOR PUBLIC USE AS PART OF THE CITY'S BRIDGE HOUSING PROJECT.
WHEREAS, Article I, Section 3 of the Avondale City Charter authorizes the City of Avondale (the "City") to acquire real property in fee simple or any lesser interest, inside or outside its corporate limits for any City purpose, when the public convenience requires it and in accordance with the provisions of State law; and
WHEREAS, Maricopa County, a political subdivision of the State of Arizona, is the owner of certain real property identified as Assessor's Parcel Number ("APN") 500-26-003B generally located north of East Western Avenue and east of North Dysart Road, in Avondale, Arizona (the "Property"); and
WHEREAS, Maricopa County desires to dedicate a portion of the Property totaling
± 2700 square feet, or 0.0620 acres to the City for public use as a setback and for the installation and maintenance of a fence or wall, and as part of the City's bridge housing project on the adjacent property ("the Easement"); and
WHEREAS, the Council of the City of Avondale (the "City Council") desires to accept the Easement for such public use.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
AVONDALE as follows:
SECTION 1. The recitals above are hereby incorporated as if fully set forth herein.
SECTION 2. The dedication of real property totaling ± 2700 square feet or 0.0620 acres, located on a portion of the parcel assigned APN 500-26-003B, in Avondale, Arizona, as more particularly described and depicted on Exhibit A, attached hereto and incorporated herein by reference, is hereby accepted by the City from Maricopa County for public use.
SECTION 3. The Mayor, the City Manager, the City Clerk and the City Attorney are hereby authorized and directed to take all steps and to execute all documents necessary to carry out the purpose and intent of this Ordinance.
