ORDINANCE NO. 2029-0726
AN ORDINANCE OF THE COUNCIL OF THE CITY OF AVONDALE, ARIZONA, ACCEPTING THREE TRAIL EASEMENTS FROM ROOSEVELT PARK UNIT 1 COMMUNITY ASSOCIATION, GENERALLY LOCATED EAST OF AVONDALE BOULEVARD AND SOUTH OF VAN BUREN ROAD FOR PUBLIC USE.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF AVONDALE as follows:
SECTION 1. A trail easement over, across and under + 0.22 acres of real property generally located east of Avondale Boulevard and south of Van Buren Road, in Avondale, Arizona and being a portion of Maricopa County Assessor's Parcel Number 101-01-960, as more particularly described and depicted in Exhibit A as part of Exhibit 1 of the Trail Easement Agreement, attached here to as Exhibit A, and incorporated herein by reference, is hereby accepted by the City of Avondale (the "City") from Roosevelt Park Unit 1 Community Association, an Arizona non-profit corporation, for public use.
SECTION 2. A trail easement over, across and under + 0.16 acres of real property generally located east of Avondale Boulevard and south of Van Buren Road, in Avondale, Arizona and being a portion of Maricopa County Assessor's Parcel Number 101-01-957, as more particularly described and depicted in Exhibit B as part of Exhibit 1 of the Trail Easement Agreement, attached here to as Exhibit A, and incorporated herein by reference, is hereby accepted by the City of Avondale (the "City") from Roosevelt Park Unit 1 Community Association, an Arizona non-profit corporation, for public use.
SECTION 3. A trail easement over, across and under + 0.27 acres of real property generally located east of Avondale Boulevard and south of Van Buren Road, in Avondale, Arizona and being a portion of Maricopa County Assessor's Parcel Number 101-01-953, as more particularly described and depicted in Exhibit C as part of Exhibit 1 of the Trail Easement Agreement, attached here to as Exhibit A, and incorporated herein by reference, is hereby accepted by the City of Avondale (the "City") from Roosevelt Park Unit 1 Community Association, an Arizona non-profit corporation, for public use.
SECTION 4. The Mayor, the City Manager, the City Clerk and the City Attorney are hereby authorized and directed to take all steps and to execute all documents necessary to carry out the purpose and intent of this Ordinance.
