ORDINANCE NO. 439
AN ORDINANCE AMENDING CHAPTERS 105 & 106 OF THE CODE OF ORDINANCES FOR THE CITY OF ADEL FOR THE PURPOSE OF ADOPTING LOCAL REGULATIONS RELATED TO THE MUNICIPAL LANDFILL
WHEREAS, on April 20, 1970, the City of Adel entered into a 28E Agreement creating the South Dallas County Sanitary Landfill Agency; and
WHEREAS, the South Dallas County Sanitary Landfill Agency was created for the purpose of collecting and disposing of solid waste within its member communities; and
WHEREAS, since 1992, the City of Adel has been the sole member of the South Dallas County Sanitary Landfill Agency; and
WHEREAS, the Adel City Council has authorized proceeding with the transfer of the assets, liabilities and operations of the South Dallas County Sanitary Landfill Agency to the City of Adel to be operated as a City enterprise, to be effective on July 1, 2026; and
WHEREAS, it is therefore necessary to adopt City regulations addressing the landfill.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ADEL, IOWA, THAT:
SECTION ONE. Section 105.02, Definitions, of the municipal code is hereby amended by adding a new definition for "Landfill" and "Operator", in correct alphabetical order, as follows:
"Landfill" means The Adel Municipal Landfill and Recycling Center located at 2000 Main Street, Adel.

"Operator" means any person who occupies, possesses, uses or owns property within the Landfill service area and/or who stores or generates solid waste within the Landfill service area.
SECTION TWO. Section 105.11, Sanitary Disposal Project Designated, of the municipal code is hereby repealed and replaced as follows:
105.11 SANITARY DISPOSAL PROJECT DESIGNATED.
The sanitary landfill facilities operated by City of Adel are hereby designated as the official "Public Sanitary Disposal Project" for the disposal of solid waste produced or originating within the City.
SECTION THREE. Chapter 105, Solid Waste Control, of the municipal code is hereby amended by adding Sections 105.12-105.14 as follows:
105.12 RULES AND REGULATIONS.
1. The Landfill Operations Director may make, amend, revoke and enforce reasonable and necessary rules and regulations governing, but not limited to:
A. Collection, transportation, processing and disposal of solid waste, including the right to determine that certain waste poses a health or safety risk and declare it unacceptable for disposal at the landfill.
B. Storage of solid waste.
C. Records of quantity and types of solid waste received at disposal facilities.
D. Handling of hazardous wastes, special wastes, toxic wastes, sludges, ashes, agricultural waste, construction waste, bulky items, tires, automobiles, oils, greases, yard waste, batteries, appliances and recyclables.
E. Billing and collection of disposal service charges at the landfill.
F. Hours of operation for the landfill.
2. A copy of any and all rules and regulations issued under the provisions of this section shall be filed in the office of the city clerk and shall be available for public inspection during normal business hours.
105.13 Disposal Restrictions at the Landfill.
1. Only persons or operators residing or operating within the Landfill service area may dispose of solid waste at the Landfill, and only provided that such solid waste was generated by activities or operations occurring within the Landfill service area.
2. The following materials may not be disposed of at the Landfill, but may be recycled at the Landfill: tires; yard waste; corrugated cardboard; computer monitors; televisions; and appliances. The person disposing of such items shall be responsible for separating these items from other solid waste materials and shall be responsible for delivering and unloading the items at the recycling sites designated by the City.
3. It is prohibited for any person or operator to dispose or attempt to dispose of any waste at the Landfill in a manner or location other than that provided for herein, by the Landfill Operations Director, or as directed by Landfill personnel.
4. Violations of any solid waste disposal requirement shall constitute either a simple misdemeanor or a municipal infraction, and each violation shall constitute a separate offense.
5. The City's costs for retrieving prohibited substances or materials from the Landfill disposal site and/or for any costs incurred by the City for cleaning up the disposal site shall be chargeable to the responsible party. Repeated violations of this section or of regulations adopted by the Landfill Operations Director shall be sufficient cause for the City's revocation of the Landfill disposal privileges of the responsible party.
105.14 Disposal Fees.
The fees for disposal of solid waste shall be established by resolution of the City Council, as set forth in the City of Adel Fee Schedule, as may be amended from time to time.
SECTION FOUR. Section 106.08(2), Fees, of the municipal code is hereby repealed and replaced as follows:
2. Fees. Fees collected pursuant to contracts entered into by the City include: Solid Waste, Recycling and Yard Waste.
SECTION FIVE. Severability. If any section, subsection, sentence, clause, phrase, or portion of this ordinance be held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not affect the validity of the remaining portion hereof.
SECTION SIX. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION SEVEN. Effective. This Ordinance shall be effective as of July 1, 2026.
SECTION EIGHT. When this ordinance is in effect, it shall automatically supplement, amend, and become a part of the said Code of Ordinances of the City of Adel, Iowa.
