ORDINANCE NO. 630 N.S.
AN ORDINANCE OF THE MAYOR AND CITY COUNCIL OF THE CITY OF TOLLESON, ARIZONA, AMENDING THE TOLLESON CITY CODE, CHAPTER 11 WASTEWATER, BY AMENDING ARTICLE 11-2 APPLICATIONS, PERMITS, PLANS AND INSPECTIONS, SECTION 11-2-2 WASTEWATER DISCHARGE PERMIT; PROVIDING FOR REPEAL OF CONFLICTING ORDINANCES; AND AUTHORIZING ALL ACTIONS NECESSARY TO CARRY OUT THE PURPOSES OF THIS ORDINANCE. WHEREAS, the Mayor and City Council find it necessary to amend the Tolleson City Code to remove the fixed permit duration requirement contained within Section 11-2-2 Wastewater Discharge Permit in order to allow the City flexibility to establish permit durations administratively through the City's Wastewater Pretreatment Program. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF TOLLESON ARIZONA, as follows: Section 1. The Tolleson City Code, Chapter 11 Wastewater, by amending Article 11-2 Applications, Permits, Plans and Inspections, Section 11-2-2 Wastewater Discharge Permit to read as follows (deletions in strikeout): CHAPTER 11: – WASTEWATER ARTICLE 11-2: – APPLICATIONS, PERMITS, PLANS AND INSPECTIONS

§ 11-2-2 - WASTEWATER DISCHARGE PERMIT. (A) Except as provided in § 11-4-5, no person shall discharge or cause to be discharged any industrial wastewater directly or indirectly to sewage facilities owned by the city without first obtaining a city permit for industrial wastewater discharge. The duration of an industrial wastewater discharge permit shall not exceed 12 months.

Section 2. Providing for Repeal of Conflicting Ordinances.
All ordinances, parts of ordinances and resolutions in conflict with the provisions of this Ordinance, or any part of the City Code adopted here by reference, are repealed to the extent of such conflict. Section 3. Providing for Severability. If any provision of this Ordinance is for any reason held by any court of competent jurisdiction to be unenforceable, such provision or portion hereof shall be deemed separate, distinct, and independent of all other provisions and such holding shall not affect the validity of the remaining portions of this Ordinance. Section 4. Providing for Authorization. The Mayor, City Manager, City Clerk and City Attorney are hereby authorized and directed to take all steps necessary to carry out the purpose and intent of this Ordinance.
