AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF DALLAS CENTER, IOWA, BY AMENDING PROVISIONS PERTAINING TO PUBLIC HEARING REQUIREMENTS – ZONING AND SUBDIVISION
Be It Enacted by the City Council of the City of Dallas Center, Iowa:
SECTION 1. SUBSECTIONS MODIFIED. Subsections 2 and 3 of Section 165.15 of the Code of Ordinances of the City of Dallas Center, Iowa, are repealed and the following adopted in lieu thereof:
2. Public Hearing Required by Commission. No proposed change in the zoning map shall be acted upon by the Council until after a public hearing thereon by the Planning and Zoning Commission. At least four days' notice of the time and place of such hearing shall be published in a newspaper of general circulation in the City. After the public hearing before the Commission, the Commission shall make a report and recommendations in writing to the Council.
3. Public Hearing Required by Council. Before taking final action, the Council shall conduct a public hearing on any proposed amendment to this chapter or change in the zoning map, and at least four days' notice of the time and place of such hearing shall be published in a newspaper of general circulation in the City
SECTION 2. SUBSECTION MODIFIED. Subsection 4 of Section 165.45 of the Code of Ordinances of the City of Dallas Center, Iowa, is repealed and the following is adopted in lieu thereof:
4. Public Notification. Following preliminary review of the Site Plan the City Clerk shall refer the Site Plan to the City Engineer and to the Planning and Zoning Commission, which shall schedule a meeting to review the Site Plan. Notice must be sent to the surrounding property owners within 200 feet of the property included within the Site Plan considered. The applicant must provide to the City Clerk a complete listing of names and addresses of the surrounding property owners. Notice of the consideration of the Site Plan and proposed wind energy conversion system shall be mailed by the City Clerk not less than four days and not more than 20 days prior to the Planning and Zoning Commission meeting at which the Site Plan is first considered. The notice shall contain the date, time and location of the Planning and Zoning Commission meeting and the subsequent City Council meeting.
SECTION 3. SUBSECTION MODIFIED. Subsection 3 of Section 170.04 of the Code of Ordinances of the City of Dallas Center, Iowa, is repealed and the following is adopted in lieu thereof:
3. Commission Review and Recommendation. After receiving the City Engineer's report, the Commission shall study the preliminary plat and other material for conformity to this chapter. The Commission may confer with the subdivider on changes deemed advisable and the kind and extent of such improvements to be made. Before approving a preliminary plat, the Commission may, at its discretion, hold a public hearing on the proposed plat, notice of which shall be given by publication in a local newspaper of general distribution, or by posting notices on the tract, or by sending notices to affected property owners by mail. Such notice shall be given within four days prior to the public hearing. The Commission shall file with the Council recommendations for approval or rejection of such preliminary plat within 45 days after the date of submission of the plat to the Commission. Upon receiving recommendations of the Commission, the Council shall consider the same, and if the plat is found to conform to the provisions of this chapter, the Council shall approve the preliminary plat.
SECTION 4. SECTION MODIFIED. Section 170.23 of the Code of Ordinances of the City of Dallas Center, Iowa, is repealed and the following is adopted in lieu thereof:
170.23 CHANGES AND AMENDMENTS. Any provision of this chapter may be changed and amended from time to time by the Council; provided, however, such changes and amendments shall not become effective until after study and report by the Commission and until after a public hearing has been held by the Council, public notice of which shall be given in a newspaper of general circulation at least four days prior to the hearing.
SECTION 5. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 6. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
