Among other matters, the Petition concerns Lots 9, 10, 11, 12, 13, 14, 15, 16, and 17, Cottage Reserve, Lake Macbride Park, Johnson County, Iowa, according to the Plat thereof in Plat Book 2, Page 83, Plat Records of Johnson County, Iowa (the "Submerged Lots"). In substance, Cottage Reserve Corporation alleges that it is the owner of the Submerged Lots and that any claim of Defendant or the Cross-Petition Defendants is without right and constitutes a cloud on Plaintiff's title. Plaintiff seeks to have title to the Submerged Lots established and quieted in its favor, to bar and estop Defendant and the Cross-Petition Defendants from asserting any right, title, or interest therein, and for such other equitable relief as the Court deems just and proper.
