836 WEST 80 LLC v. CH REALTY X/CG NOURIA PORTFOLIO, L.L.C., et al. -- State of Georgia, County of Chatham -- IN THE SUPERIOR COURT OF CHATHAM COUNTY -- Civil Action No. SPCV25-00952-KA -- Official Notice of Petition for Private Way in Accordance with O.C.G.A. § 44-9-40 through § 44-9-48.
Notice is hereby given that 836 West 80 LLC, Petitioner, has filed in the Superior Court of Chatham County, Georgia a Petition for Private Condemnation seeking to condemn a private way of necessity pursuant to O.C.G.A. § 44-9-40, et seq., over and across the lands of the Respondents, in order to obtain access, ingress, and egress to Petitioner's property, which is otherwise without a reasonable means of access.
The easement to be condemned is a proposed twenty-foot (20') access easement in the City of Pooler in Chatham County, Georgia and being known as a 20' Access Easement located on and adjacent to Lots 1 and 2 as shown upon a plat entitled "Recombination of Property of the former Lester R. Shearouse property and the Georgia Forestry Commission" as prepared by Lanier Land Surveying and Inman L. Lanier, G.R.L.S. No. 2397, dated August 12, 1999, and recorded in Plat Book 22P, page 5, Chatham County, Georgia records, said plat being incorporated herein and made a part hereof by this reference and said 20' Access Easement being more particularly described as follows:
Commencing at the intersection of the northern right of way line of U.S. Highway 80 with the western right of way line of Durden Drive; thence proceed along said northern right of way line of U.S. Highway 80 N70°12'16"W, a distance of 150.00' to a ¾" iron rod; thence N70°12'16"W, a distance of 196.19' to the POINT OF BEGINNING; Thence continue along said northern right of way line of U.S. Highway 80 N70°12'16"W, a distance of 20.00' to a point; Thence leave said northern right of way line of U.S. Highway 80 and proceed the following courses and distances: Thence N18°50'23"E, a distance of 52.82' to a point; Thence N24°21'53"W, a distance of 54.47' to a point; Thence N34°25'55"E, a distance of 23.38' to a point; Thence S24°21'53"E, a distance of 74.50' to a point; Thence S18°50'23"W, a distance of 61.07' to the POINT OF BEGINNING, said 20' Access Easement having an area of 2,429 square feet, more or less.
The easement is sought to provide Petitioner a means of ingress, egress, and access from U.S. Highway 80 through the existing curb cut on the above-described property to Petitioner's property, being known as 836 U.S. Highway 80, Pooler, Georgia 31322, designated as Lot 1 and containing 5.87 acres as shown on that certain plat recorded in Plat Book 22-P, Page 4, Chatham County, Georgia records, having tax parcel number 5-0008A-04-008.
The owner of the property over which the easement is sought to be condemned is CH Realty X/CG Nouria Portfolio, L.L.C. The property is leased to, and the Enmarket gas station and convenience store thereon is operated by, EM Alnour M.T. of GA, LLC. Both CH Realty X/CG Nouria Portfolio, L.L.C. and EM Alnour M.T. of GA, LLC are named as Respondents in the above-styled action.
