PLEASE TAKE NOTICE that on Monday, March 9, 2025, at 7:00 p.m., a hearing will be held before the Township of Riverside Planning Board in the Township of Riverside Municipal Building, located at 1 W. Scott Street, Riverside, New Jersey 08075, regarding an application for minor subdivision approval, preliminary and final major site plan approval and variances pursuant to N.J.S.A. 40:55D-70(d)(1) and N.J.S.A. 40:55D-70(c), for property located at 220 South Pavilion Avenue in the Township of Riverside and identified as Block 13.01, Lot 9 on the Riverside tax maps (the "Property"). The Applicant and Owner is Esti Investors, LLC. The Property is currently improved with a mixed-use building with nine residential units, 1,212 square feet of ground floor commercial space, 17 surface parking spaces and six garages. The property is a corner lot with primary frontage on South Pavilion Avenue and secondary frontage and vehicular access on Second Street. The northeast portion of the lot fronting on South Pavilion Avenue is unimproved. Applicant proposes to subdivide the unimproved portion of the Property and construct a new, 2.5-story mixed-use building with 1,212 square feet of commercial ground floor space, two residential units with living area on both the second and third floors, and four on-site parking stalls. The Property is located in the CD, Commercial District, which conditionally permits mixed-use buildings
In addition to minor subdivision approval and preliminary and final site plan approval, Applicant will seek a (d)(1) use variance because although mixed use buildings are conditionally permitted in the CD Zone, there are no conditional use standards governing the use set forth in the zoning ordinance and thus the proposed use was deemed not permitted. Additionally, (c) variances are required for (i) the depth of the newly created lot where 86.41 feet is proposed and 100 feet required; (ii) the side yard setback to the subdivision line of the existing building on the remainder lot where 5 feet is proposed and 8 feet required; (iii) the side yard setback to the subdivision line of the proposed building on the new lot where 5 feet is proposed and 8 feet required and the combined side yard setback on the new lot where 12.67 feet is proposed and 16 feet required; (iv) lot coverage on the remainder lot with 79.8% existing, 100% proposed and 80% permitted; (v) the square footage of the existing accessory buildings on the remainder lot with 2,059 square feet existing, 1,867 square feet proposed and 1,000 square feet permitted; (vi) the square footage of the existing garages on the remainder lot, with 1,441 square feet existing, 1,249 square feet proposed and 750 square feet permitted; (vii) the number of parking spaces, with 17 existing, 23 proposed and 47 required; and (viii) no loading space. Applicant will also seek waivers for a drive aisle width on the new lot of 22 feet, with 24 feet required, for no street trees, and for the lack of a 15-foot landscape buffer. Waivers are also sought from certain site plan submission requirements. Vehicular access to the new lot will be through the existing parking lot.
Applicant also requests that the Board grant any additional approvals, permits, variances, interpretations, waivers or exceptions reflected in the plans and materials filed (as same may be amended or revised from time to time without further notice) or determined to be necessary during the review and processing of this application. Any persons interested in this application may be heard at the meeting. The application and plans are on file in the Township of Riverside Municipal Building, 1 W. Scott Street, Riverside, New Jersey 08075, and are available for inspection by the public during normal business hours, Monday through Friday.
