PROGRAMMATIC DETERMINATION OF NONSIGNIFICANCE
Description of Proposal: 2026 Title 17 Definition Edits. This State Environmental Policy Act (SEPA) decision is for amendments to Kitsap County Code Title 17 (zoning). The objectives of these code amendments include: Provide clarification to the definition of "Research laboratory" that facilities whose primary function is equipment operation, utility service provision, storage, warehousing, or other activities not involving ongoing research, investigation, testing, or experimentation by on-site personnel are not research laboratories.Provide clarification to the definition of "Warehousing and distribution" as a facility where physical goods, merchandise, materials, or equipment are stored for subsequent distribution, sale, transfer, or use elsewhere.

The lead agency for this programmatic, non-project action has determined that the project does not have a probable significant adverse impact on the environment. Accordingly, an environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a completed environmental checklist and other information on file with the lead agency. This information is available to the public on request.
This programmatic DNS is issued under WAC 197-11-340(2) and is not administratively appealable under Chapter 21.04 KCC. The lead agency will not further act on this proposal for 14 days from the date below. Further, public comment period will run concurrently with this SEPA Determination. Comments must be submitted by July 14, 2026.
