BOROUGH OF POINT PLEASANT BEACH
ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that on November 6, 2025 at 7:30 p.m. the Borough of Point Pleasant Beach Zoning Board of Adjustment, ("the Board"), located at Borough Hall, 416 New Jersey Avenue, Point Pleasant Beach, NJ 08742, will hold a Public Hearing on the application filed by Elizabeth Smith and Lester Bianco ("the Applicants") with respect to the property identified as Block 51, Lot 20 on the Borough of Point Pleasant Beach's Official Tax Map and simultaneously bearing the address of 400 Atlantic Avenue in Point Pleasant Beach, New Jersey 08742, which is located in the SF-5 Single-Family Residential District ("Property"), seeking bulk variance relief to construct a pool, patio, deck, and garage, along with a fence (which will serve as a pool barrier).
The Applicants are the owners of the Property, which is a corner lot, with frontages on both St. Louis Avenue and Atlantic Avenue, and is currently improved with a two and one-half-story, single-family dwelling. The Applicants are proposing to construct a new pool, deck, and patio (which patio will use permeable pavers) on the Property, enclosed by a six-foot-tall fence (serving as the required pool barrier). The Applicants are also proposing to construct a garage in a similar location as a prior garage, in the rear of the Property. The proposed deck contains a ramp for a disabled family member, providing access from St. Louis Avenue, into the Property and up onto the proposed deck.
Pools and fences are permitted accessory uses in the SF-5 zone and because the Property is a corner lot, the proposed pool, deck, and patio (and a portion of the fence) will be located in a "front yard", subject to the applicable bulk regulations associated therewith.
The Applicants request the following bulk variance relief:
• Accessory setback of 5 feet for the proposed garage is required where approximately 1.57 ft is proposed from the side and approximately 1.51 ft is proposed from the rear – Borough Code §19, Att. 1 (Schedule of District Regulations).
• Pool equipment setback of 5 ft is required where approximately 2.6 ft is proposed – Borough Code §19, Att. 1 (Schedule of District Regulations).
• Front yard setback of 25 ft is required whereas 3.1 ft is proposed to deck/ramp (St. Louis Ave) – Borough Code §19, Att. 1 (Schedule of District Regulations).
• Maximum building coverage allowed of 30% is permitted whereas 48.93% is proposed – Borough Code §19, Att. 1 (Schedule of District Regulations).
• Maximum impervious coverage allowed of 50% is permitted whereas 51.35% is proposed – Borough Code §19, Att. 1 (Schedule of District Regulations).
• 6 ft fence proposed in side yard where 4 ft is permitted – Borough Code §19-11.4b.
• 6 ft fence proposed in front yard where 3 ft is permitted – Borough Code § 19-11.4b.
The Applicants further reserve the right to seek any and all additional variances, variations, waivers and interpretations as the Board and/or its professionals may determine to be required.
Members of the public may appear at said hearing and participate and be heard therein in accordance with the rules of the Borough of Point Pleasant Beach's Zoning Board of Adjustment either with or without an attorney and present any comments or objections which they may have to the granting of the relief sought in the application.
The application is on file in the Borough of Point Pleasant Beach located at 416 New Jersey Avenue, Point Pleasant Beach, NJ 08742 and is available for inspection on any business day between 8:30 a.m. - 1:00 p.m. and 2:00 pm – 4:00 pm Monday through Friday.
