ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that on April 20, 2026, at 7:30 p.m. at the Council Chambers of the Township of Wayne Municipal Building, 475 Valley Road, Wayne, New Jersey 07470, the Township of Wayne Zoning Board of Adjustment will hold a public hearing on an application filed by IPRAY House, Inc. (hereinafter sometimes referred to as the "Applicant") seeking Preliminary and Final Major Site Plan, "d(3)" Conditional Use Variance, and Environmental Protection (EP) Waiver Approval for the construction of a house of worship (i.e., mosque) with ancillary uses.
Applicant will also seek any and all additional relief identified throughout the application process including, but not limited to: other use or bulk variances, exceptions or waivers.
The property is known as 225 Colfax Road, Wayne, New Jersey, and identified as Block 3517, Lot 26, and is located in the Low-Density Residential (R-30) Zoning District.
The subject property (referred to herein as "the Site") is located at 225 Colfax Road and is comprised of Block 3517, Lot 26 totaling 9.998 acres. The Site is a rectangularly shaped, interior lot located within the Township's R-30 Low-Density Residential Zone with approximately 1,092.6 feet of frontage on Colfax Avenue. The Site is undeveloped and wooded with no vehicular access. Mapped wetlands and wetland transitions areas exist; steep slopes exist in the rear portion of the Site.
Applicant proposes a building footprint of approximately 19,963 square feet and a total floor area of approximately 53,300 square feet. The house of worship will consist of approximately 8,400 square feet of prayer area and multi-purpose space, classrooms, cultural rooms, kitchen, offices, and an enclosed courtyard. The proposal also includes parking areas surrounding the rear and sides of the proposed house of worship with 251 parking spaces provided. Additional site improvements, such as landscaping, stormwater management, and lighting, are also proposed.
The proposed house of worship is listed as a conditionally permitted use in the R-30 zoning district under § 134-33.3 with the required conditions included in § 134-63.4A. The proposed house of worship requires the following variance relief pursuant to § 134-63.4 of the Township Ordinance and N.J.S.A. 40:55D-70d.
Variances Required
1. § 134-63.4A & N.J.S.A. 40:55D-70d(3) – Minimum Lot Area. The existing lot area totals 9.998 acres, whereas a maximum lot size of 2.5 acres is permitted. A "d(3)" conditional use variance is required.
2. § 134-63.4I(1) & N.J.S.A. 40:55D-70d(3) – Minimum Parking Area Setback. A minimum setback of 50 feet from any residential property line is required for all parking areas, whereas the proposed rear parking area is setback 30 feet from adjacent Block 3517, Lot 43, which is also located within the R-30 Residential Zone. A "d(3)" conditional use variance is required. To the extent this triggers a bulk variance, then such bulk variance will be sought.
3. § 134-63.4J(1) & N.J.S.A. 40:55D-70d(3) – Maximum Signage Quantity. A maximum of one (1) freestanding ground or monument sign is permitted, whereas two (2) signs are proposed (one fully compliant freestanding sign and one wall mounted sign). A "d(3)" conditional use variance is required. To the extent this triggers a "(d1)" use variance and/or bulk variances, then such variances will be sought.
Submission Waivers Required
The following submission waivers are required:
1. § 134-111.5.4: Letter of Interpretation (LOI) or Presence/Absence letter from the NJ DEP.
2. § 134-111.5.43: The location of all existing of the following for on-site and on-tract: storm drainage ponds; streams; above-ground utility lines and appurtenances, including transformer boxes; below-ground utility lines and appurtenances; pipe sizes, grades and direction of flow; outdoor storage areas (for applications where outdoor storage is proposed).
3. § 134-111.5.44: The location of the following existing off-tract items within 200 feet from the extreme limits of the property in question: storm drainage ponds; streams; above-ground utility lines and appurtenances; below-ground utility lines and appurtenances; pipe sizes, grades and direction of flow.
4. § 134-111.5.55: Wetlands and wetlands transition areas in accordance with the LOI.
The application is on the referenced Zoning Board of Adjustment's public hearing agenda to be held on April 20, 2026, at 7:30 p.m. at the Township of Wayne Council Chambers, Township Hall, 475 Valley Road, Wayne, New Jersey 07470.
When this case is called, you may appear either in person or by an attorney and present any comments or objections which you may have to the granting of the relief sought in the application. Any interested party may appear at said hearing and participate therein in accordance with the rules of the Township of Wayne Zoning Board of Adjustment.
In addition, the Township of Wayne Zoning Board of Adjustment intends to broadcast the meeting. Television access will be available on the local cable T.V. channel and on the Township of Wayne's website.
The application and physical documents is on file in the office of the Township of Wayne Planning Department, Municipal Building, 475 Valley Road, Wayne, New Jersey 07470 and is available for inspection by interested persons weekdays during regular office hours (between 8:30 A.M. and 4:30 P.M. Monday through Friday and until 7:30 P.M. Tuesdays). This notice is being published by the Applicant as required by the State of New Jersey's Municipal Land Use Law (NJSA 40:55D-10 and 12).
