TOWNSHIP OF WAYNE
ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that on October 20, 2025, at 7:30 p.m. at the Council Chambers of the Township of Wayne Municipal Building, 475 Valley Road, Wayne, New Jersey 07470, the Township of Wayne Zoning Board of Adjustment will hold a public hearing on an application filed by 61-69 Mountain View Boulevard, LLC (hereinafter sometimes referred to as the "Applicant") seeking a Certificate of Pre-Existing Nonconforming Use pursuant to N.J.S.A. 40:55D–68 for four (4) pre-existing residential units on top of retail and (d)(2) expansion of a nonconforming use variance relief pursuant to N.J.S.A. 40:55D-70(d)for the installation of a dumpster (for a delicatessen tenant as part of the retail uses) with Minor Site Plan Approval for the property located at 61-69 Mountain View Boulevard (Block 709, Lot 2 on the Official Tax Map of the Township of Wayne)("Property"), in the B-Business District. In the alternative, if a Certificate of Pre-Existing Nonconforming Use is not granted by the Board or is only partially granted, the Applicant requests "D" or use variances pursuant to N.J.S.A. 40:55D-70(d) for a (d)(1) use variance or a (d)(2) expansion of a nonconforming use variance with Minor Site Plan Approval.
The Property is currently improved with a two-story, mixed-use building, with first floor retail space and four (4) second floor apartments, which have existed since at least 1911 (and possibly as far back as 1902). The Applicant proposes to (1) install a dumpster on concrete, enclosed by a six-foot-tall cedar solid picket fence and gate; (2) stripe and refinish the six (6) parking spaces, one of which is ADA dedicated; and (3) add parking area signage and wheel stops to the parking area. The Applicant is not changing the footprint of the building or performing any renovations thereto (other than to install the dumpster and restripe and finish the parking area).
The Applicant also requests the following "C" or bulk variances pursuant to N.J.S.A. 40:55D-70(c) associated with the application (which are subsumed within the "D" variances, technically leaving just the "D" variances) as follows:
§134-43.3.A: Lot Area: A minimum lot area of 20,000 square feet is required, whereas 9,144 square feet is existing and proposed.
§134-43.3.C: Lot Depth: A minimum lot depth of 200 feet is required, whereas 79.80 feet is existing and proposed.
§134-43.3.D: Impervious Coverage: A maximum impervious coverage of 70% is permitted, whereas 100% is existing and proposed.
§134-43.3.E(1): Front Yard Setback: A minimum front yard setback of 20 feet is required whereas a 0-foot setback is existing and proposed along Mountain View Boulevard, and 0.6-foot setback is existing and proposed along Legion Place.
§134-43.3.E(2): Side Yard Setback: A minimum side yard setback of 20 feet is required, whereas a 5-foot setback is existing and proposed.
§134-43.3.E(3): Rear Yard Setback: A minimum rear yard setback of 50 feet is required, whereas a 20.4-foot setback is existing and proposed.
§134-31.2A: Number of Parking Spaces: A minimum of 33 parking spaces are required whereas 6 parking spaces are proposed.
The Applicant also requests waivers from checklist items, if any, that have not been supplied or identified and will seek any and all other variances, exceptions, exclusions, waivers, and other relief that may become deemed necessary though the application process.
Members of the public may appear at said hearing and participate and be heard therein in accordance with the rules of the Township of Wayne Zoning Board of Adjustment either with or without an attorney and present any comments or objections which they may have to the granting of the relief sought in the application. Television access will be available on the local cable T.V. channel and on the Township's web site.
The application is on file in the office of the Township of Wayne Planning Department, 475 Valley Road, Wayne, New Jersey, and is available for inspection during regular office hours (8:30 a.m. to 4:30 p.m.), Monday through Friday and until 7:30 p.m. on Tuesdays.
