Zoning Board of Adjustment
PLEASE TAKE NOTICE:
That Houseshare, LLC c/o Ben Stoica has applied to Berkeley Township Zoning Board of Adjustment for plot plan approval, "C" Variance and a Zoning/Building Permit for Construction of a single family home on a road not constructed to the specification of Chapter XXXV. This property is located in the R-150 Residential Zone at 0 Seabrook Avenue, Berkeley Township, NJ 08721, also known as Block 425, Lot 5, 6, 7, & 8 as shown on the official tax map of Berkeley Township.
The Applicant seeks the following variances and/or design waivers for relief from the following requirements:
Applicant seeks relief under N.J.S.A. 40:55D-35 pursuant to N.J.S.A. 40:55D-36 for a "C" variance to construct a single family dwelling along a road not constructed to a township standard. The Applicant further seeks to consolidate tax lot 5, 6,7,8 tax block 425 into one lot.
The Applicant also seeks the following design waivers:
- §35-53.3 – Concrete curbing shall be constructed along the edge of all paved surfaces, whereas no curb exists or is proposed.
- §35-67.1 – Sidewalks are required along all streets, whereas no sidewalk exists or is proposed.
- §35-65.c – Roadways shall be at least 30 ft wide, whereas 26 ft is proposed.
- §23-2.6 – A Tree Removal/replacement plan showing no more than 50% of each side yard shall be disturbed, whereas more than 50% is be proposed to be cleared.
In view of the fact that the Zoning Officer of the Township of Berkeley, New Jersey, denied approval of this request by reason of it's being in violation of Code Reference # 35-95 Section 1 of the Municipal Zoning Ordinance, the applicant may seek additional variances and/or waivers and exceptions or interpretations as required by law or Berkeley Township Zoning Board of Adjustment including but not limited to re-approval and/or reaffirmation of any and all other relief that may have been granted in any prior applications.
This application will be heard by Berkeley Township Zoning Board of Adjustment at a public meeting on April 8, 2026 in the Meeting Room of the Municipal Building at 627 Pinewald-Keswick Road, Bayville, New Jersey. The meeting will commence at 6:30 p.m at which time you may appear either in person or by an attorney and present any objection or questions you may have to the granting of this application. The application and supporting documents of this application are on file with the Zoning Board of Adjustment Secretary and may be inspected by you during the hours of 9:00am to 3:00pm at the Township of Berkeley at 627 Pinewald-Keswick Road, Bayville, New Jersey.
