Borough of Paramus
Please take notice HAZA Bell of NE ("Applicant") has applied to the Borough of Paramus Planning Board for approval for a proposed Taco Bell drive-thru restaurant at 565 Route 17, Block 5005, Lot 3 on the Borough of Paramus Tax Map.
Applicant is seeking preliminary site plan and final site plan approval as well as variance relief required for the proposed Taco Bell drive-thru restaurant which includes the following: 1) §371-35H - Minimum parking stall size required is 9' by 19' whereas 9' by 18' is proposed; 2) §129-32E - No parking areas are permitted in required front yards, and such front yard areas shall be free of paving except for walkways and for driveways crossing at or about right angles; 3) 429-125 - The minimum distance of any building on a parcel or lot contiguous to any conservation/recreation zone (CR) shall be not less than the greater of 100 feet or twice the height of the closest building to the residential zone. A setback to the adjacent CR zone of 46.8' exists and a setback of 74.6' is proposed; 4) §429-166A - All outdoor dining areas shall be limited to not more than 20% of the total maximum permitted seating for the establishment. Two (2) outdoor dining seats are permitted whereas twelve (12) are proposed; 5) §367-12H(2)(d) - No freestanding sign panel shall exceed a height of 8' whereas 9.43' is proposed; 6) §367-12H(2)(c) - The top of any freestanding sign shall not exceed 18 feet from the ground level whereas 20' is proposed; 7) §367-12F(3)(d)[3] - For sign illumination, the letters, logos and symbols may take up a maximum of 40% of the sign area, leaving 60% opaque; the two (2) 42" face lit bell signs exceeds 40% maximum; 8) §367-12H(6)(b) -Window signs shall be contained entirely within the ground level interior of the building in which the business is located where signs are proposed on the 2nd level of windows of the building; 9) §367-12H(6)(c) - No window sign, temporary or otherwise, on the inside of a window shall be greater than two feet in height whereas the proposed signs fill the entirety of the windows at 8.5'; 10) §367-12H(6)(c) - No window sign, temporary or otherwise, on the inside of a window shall cover more than 20% of the square footage of said window, but in no case shall such sign be greater than the total of 16 square feet of the total glass area of each wall whereas 100% coverage of the window is proposed and over the 2' in height requirement; 11) §367-12H(2) – Street address numbers on business freestanding signs shall have a height of 8" on state highways where no address is provided; 12) §367-12I(7)(b) – small directional sign is permitted to be no more than 4 sf in area and no more than 4' in height where the proposed pickup directional sign is 7.5 sf in size and 5' in height; 13) §371-40A - A planting easement shall be provided by the developer of up to 10 feet from the street line, where necessary to allow a planting strip of minimum of 20 feet from the street curb face.
The applicant is also seeking a waiver from §371-33H - The maximum illumination at any point on adjacent properties shall not exceed 0.2 footcandle.
In addition to the foregoing described approvals, the Applicant will also seek approval for any and all variances, exceptions, waivers, and other incidental relief that may be required or deemed necessary by the Planning Board after or during its review of this Application, together with any further relief that may be deemed necessary by the Applicant during the hearing process, including that which may be generated by way of revised plans and submission of same. Measurements, percentages and other calculations provided in this notice are in accordance with the development plans filed with the Application. Please note that to the extent that plan and/or Application revisions are made during the hearing process, these measurements, percentages and other calculations will likely change, as may the associated relief required per the Borough Code. The Applicant reserves the right to amend its application accordingly.
A public hearing is scheduled before the Board of Paramus Planning Board on June 18, 2026 at 7:00 pm in the Paramus Borough Hall, 1 Jockish Square, Paramus, New Jersey.
