PUBLIC NOTICE Borough of Wallington NOTICE IS HEREBY GIVEN that the following proposed ordinance was introduced and passed on first reading at a meeting of the Borough Council of the Borough of Wallington, County of Bergen, State of New Jersey, held on October 2, 2025, and that said ordinance will be taken up for further consideration for final passage at the meeting of said Borough Council to be held at its meeting room in the Wallington Civic Center in Wallington, N.J. on October 16, 2025 at 6:30 P.M., or as soon thereafter as said matter can be reached, at which time and place all persons who may be interested therein will be given the opportunity to be heard concerning the same. A copy of this ordinance has been posted on the bulletin board upon which public notices are customarily posted in the Wallington Civic Center and a copy is available up to and including the time of such meeting to the members of the general public of the Borough who shall request such copies, at the Office of the Borough Clerk in said Civic Center in Wallington, NJ. ORDINANCE NO. # 2025-022 AN ORDINANCE TO AMEND AND SUPPLEMENT CHAPTER 307 ARTICLE III OF THE CODE OF THE BOROUGH OF WALLINGTON TO ADD A SUBSECTION 307-17.2 ENTITLED "PARKING ON PUBLIC PROPERTY" WHEREAS, §307 of the Code of the Borough of Wallington regulates Vehicles, Traffic and Parking on public roadways within the Borough; and WHEREAS, the Mayor and Council seek to amend the Borough code to ensure that no vehicles remain parked on public roadways for prolonged periods of time without proper authorization; and WHEREAS, enforcement of traffic laws in the Borough rests with the Borough Police Department; and WHEREAS, the Chief of Police has identified a need for this ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE BOROUGH OF WALLINGTON, COUNTY OF BERGEN, AND STATE OF NEW JERSEY, AS FOLLOWS: SECTION ONE: Section §307 of the code of the Borough of Wallington is amended to include the following new subsection: §307-17.2 Parking of Public Property. (a) Definitions. The terms, phrases and words used in and for the purpose of this article shall have the same meaning as set forth in N.J.S.A. 39:1-1. (b) Time Limitations. It shall be unlawful for any person to park a motor vehicle on any highway, roadway or municipal property in the same place within the Borough of Wallington for a period of more than seventy-two (72) consecutive hours. (c) Removal of vehicles; fees. Whenever a motor vehicle is parked contrary to the provisions of this article, in addition to the penalties set forth in this article, a member of the Wallington Police Department may provide for the removal of such vehicle without the necessity of a notice to the owner of said vehicle. The owner of such motor vehicle shall pay reasonable costs of removal and storage as established by the Mayor and Council. (d) After removal of such vehicle, the Borough Police Department shall make diligent efforts to identify and locate the owner of the removed motor vehicle and shall advise such person as to the place to which said vehicle is being stored. In the event the vehicle is unclaimed, the Borough may proceed according to §340-43. (e) Notification to police of extended absence. Any person absent from the Borough of Wallington and who is unable, for good cause, to comply with the time limitations set forth in §307-17.2(b) of this article shall give notice to Police Department of the Borough of Wallington of such fact and the location of such person's motor vehicle, together with the make, model and license number thereof, either personally or in writing. Upon receipt of such notification, such person and such motor vehicle shall not be deemed to be in violation of the provisions of this article, notwithstanding that the time requirements of §307-17.2(b) are not complied with. (f) Violations and Penalties. Unless another penalty is provided by New Jersey statute, and in addition to the costs referenced in §307-17.2(c), violations of the provisions of this article shall be punishable as provided in Chapter 1, Article II, General Penalty. (g) Police Department is designated as the responsible Department for enforcement of the conditions of this Article. SECTION TWO Repealer: All Ordinances or parts of Ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency only. SECTION THREE: Severability: If any section, subsection, paragraph, sentence or other part of this Ordinance is adjudged unconstitutional or invalid, such judgment shall not affect, impair or invalidate the remainder of this Ordinance, but shall be confined in its effects to the section, subsection, paragraph, sentence or other part of this Ordinance directly involved in the controversy in which said judgment shall have been rendered and all other provisions of this Ordinance shall remain in full force and effect. SECTION FOUR: Effective Date: This Ordinance shall take effect immediately upon final adoption and publication and in the manner provided by law. October 8 2025 LNYS0383426 $107.36
