PUBLIC NOTICE OF DEFAULT
FOUNDATION POINTE HOMEOWNERS ASSOCIATION, INC. ("FPOA") together with all officers, agents, assigns, attorneys, and representatives are hereby declared irrevocably in Default. Default was established by sworn affidavits, notarial presentments, and a final Notarial Certificate of Default, all duly served with full opportunity to cure. Perfected filings include a UCC-1 Notice (Iowa SOS #E25049416-0); Recorded Fee Schedule (Pima Co., AZ #20250150004); and Recorded Notice (Polk Co., IA #2025-00073888) confirming FPOA never had, does not now have, and is permanently barred from claiming any right, title, interest, authority, or standing over the private property. No verified proof of claim or admissible evidence rebutting the record has been produced. The record therefore remains unrebutted, operative, final & conclusive for all record, notice, & reliance purposes. Any lien, levy, encumbrance, foreclosure activity, or adverse claim by FPOA is disputed, denied for lack of demonstrated standing or authority, and is null, void, unlawful, and without legal effect. FPOA remains in Default. This Notice binds all public and private parties, and all rights & remedies of the Secured Party remain fully in force.
