The subject of the hearing will be Vanderveer Properties Inc. ("Applicant"), Application No. 26-001, application for a variance from Borough Ordinance 21-10.10(a) pursuant to N.J.S.A. 40:55D-70d(1) ("d(1) use variance"). The applicant is the owner of the property commonly known as 141 Vosseller Avenue, Block 20, Lot 2, which is located in the R-4 zone. This property previously contained a two-story, four-family dwelling that was destroyed in a fire on February 28, 2025, and the Applicant proposes to rebuild this structure. A two-story, four-family structure is not a permitted use in the R-4 zone, necessitating a d(1) use variance from Borough Ordinance 21-10.10(a).
Variances will be required from the Borough of Bound Brook as follows:
At this time, the Applicant is requesting variance relief from Borough Ordinance 21-10.10(a) pursuant to N.J.S.A. 40:55D-70d(1). Borough Ordinance 21-10.10(a) permits one- and two-family residential dwellings in the R-4 zone, where "two-family dwellings" are defined as two single-family dwellings, on separate lots, but attached vertically by a party wall. The Applicant is seeking to rebuild the two-story, four-family dwelling on the property that was previously destroyed in a fire. The applicant is only seeking a d(1) use variance pursuant to this application and will seek further land use approvals pursuant to a separate application at a later date, if the Board approves this application.
Applicant seeks any other approvals, waivers, and variances from the requirements of the Zoning Regulations Ordinance that the Planning Board may find necessary or required at the hearing in this matter.
This plan is for the site known as Block 20, Lot(s) 2 located at 141 Vosseller Avenue, Borough of Bound Brook, NJ which is located in the R-4 Zoning District.
The application and supporting documents are on file with the Secretary of the Borough of Bound Brook Planning Board and may be inspected at the Borough of Bound Brook Municipal Building, Planning Department, located at 230 Hamilton Street, Bound Brook, New Jersey 08805 during regular business hours Monday through Friday, 9:00 am to 4:00 p.m.
Any interested party may appear at said hearing and participate therein in accordance with the regulations of the Municipal Land Use Law and rules of the Board.
