PUBLIC NOTICE
Tiffany DeRita ("Applicant") has filed an application for development with the City of Burlington Joint Land Use Board ("Board") regarding real property located at property located at 305 High Street and designated as block 135, lot 2 on the municipal tax map. The property is located in the TC-1 Town Center District and is improved with a commercial row building with vacant commercial space on the first floor and an apartment on the second floor. The Applicant seeks a site plan waiver and conditional use approval to permit the conversion of the first floor to a licensed body art studio with six (6) tattoo stations, one (1) piercing station and a designated waiting area. Body art studios are a conditional use in the TC-1 zone, as set forth in section 207-90(M) of the City's land development ordinance. The only condition set forth in Section 207-90(M) is that the requirements of N.J.A.C. 8:27 are met. The Applicant complies with those requirements. No changes to the exterior of the property are proposed, other than for signage.
The Applicant seeks approval of the following variances under the municipal land use ordinance:
1. Section 207-77.B(6)(a) Rear Yard/Frontage Signage: Businesses with rear properties adjacent to public property or right-of-way shall install appropriate signage in accordance with Chapter 285 (Signs) to identify businesses occupying the structure and to provide a formal entryway compatible with the architectural integrity of the building. The rear of the subject property is adjacent to public property, and the Applicant does not propose signage at the rear at this time.
The Applicant also requests any additional variances, submission waivers, exceptions, design waivers, de minimis exceptions, interpretations, modifications of conditions of prior approvals, continuation of any preexisting non-conforming conditions, conditional use approval, other approvals reflected on the plans (as same may be further amended or revised from time to time without further notice) as may be determined to be necessary during the review and processing of the application by the Board and its professional staff, and permits requested or required by the Board at the public hearing.
This application shall be considered by the Board at a public hearing on April 22, 2026 at 7:00 p.m. in-person in the Burlington City Municipal Building, City Hall, 525 High Street, Burlington, New Jersey 08016, at which time you may appear either in person or through an attorney and present any objection that you may have to the granting of this application. A copy of the application and supporting documentation is on file in the Board's office in the Burlington City Municipal Building, City Hall, 525 High Street, Burlington, New Jersey 08016, and is available for public inspection during regular business hours.
