PUBLIC NOTICE PLEASE TAKE NOTICE that in accordance with the requirements of the Cherry Hill Township Ordinances and New Jersey Municipal Land Use Law N.J.S.A. 40:55D-12, you are hereby notified that an application has been filed by BAPS Cherry Hill LLC ("Applicant") with the Cherry Hill Township Zoning Board of Adjustment Administrator. The specific nature of the application and requested relief is detailed further below. The application plans and documents will be available for examination and review at least ten (10) days before the hearing on the Cherry Hill Township Department of Community Development's ("Department") webpage at https://www.chnj.gov/117/Zoning-Board-of-Adjustment. PROPERTY INVOLVED: APPLICATION No.: 25-Z-0027 STREET ADDRESS: 5 Carnegie Plaza TOWNSHIP TAX MAP: Block 468.03, Lot 5 PRESENT USE: Religious temple PROPOSED USE: Religious temple with the additions described below NATURE OF RELIEF OR VARIANCES REQUESTED: The Applicant proposes to renovate and expand the existing Hindu temple located on the property identified above. The Applicant proposes to renovate the existing temple to offer improved services that are more functional than exist today. The size of the worship areas, including the sanctum, are not changing; no seats are being added. The Applicant will not be offering any new services or facilities other than the inclusion of an indoor gymnasium. Rather, the Applicant would like to offer more efficient, modern, and functional services than they currently offer other than the gymnasium. The Applicant is expanding the building by approximately 18,330 s.f. (from 65,650 s.f. to 83,980 s.f. +/-); this expansion consists of approximately 2,980 s.f. first floor building addition and a new second floor addition of approximately 15,350 s.f. on the right side of the building to house the proposed gymnasium. A parking lot expansion is also proposed, which will add 23 parking spaces. In addition, a drop off area at the front of the building, modifications to the ADA parking, a new loading area and a new trash enclosure are proposed. The required 25 ft residential buffer along the south property line will remain. Although the Applicant proposes to expand the existing building, it is not doing so to expand building capacity for a larger congregation, as evidenced by the fact that the worship areas and number of seats will remain unchanged. The property is located in the IR (Industrial Restricted) zoning district. A place of worship is not a permitted use in the IR zone. Therefore, the Applicant seeks D(2) variance approval form the Zoning Board to expand an existing nonconforming use. Furthermore, the Applicant seeks D(6) variance approval from the Zoning Board for the height of the temple's steeples to be more than 10% or 10 feet above the maximum building height permitted by the Township's zoning ordinance. The Applicant seeks approval of the following variances under the municipal land use ordinance: 1. Section 419.B - A use variance under N.J.S.A. 40:55D-70(D)(2) (expansion of a nonconforming use) is necessary from §419.B of the Zoning Ordinance to permit the expansion of a legal nonconforming house of worship/religious institution in the IR zone, where such uses are not specifically permitted. The Applicant proposes to expand the nonconforming use, as described above, which requires a D(2) use variance. 2. Section 40-419.F.1.– permits a maximum building height of 35 feet. The Applicant proposes a building height of approximately 58' (as measured to the top of the tower elements/shikhara above the roofline of the temple). A shikhara is a tower element or spire above the main shrine of a Hindu temple, or mandir. The Applicant also proposes a building height that exceeds the ordinance limit on the east side of the building in the gymnasium area of approximately 49.5 feet, as a result of the additional interior space in the building including the gymnasium. These proposed building heights exceed the ordinance limit of 35' by more than 10 feet or 10% of the ordinance maximum building height, therefore, a variance is required pursuant to N.J.S.A. 40:55D-70(D)(6). The Applicant also requests any additional variances, submission waivers, additional exceptions, design waivers, de minimis exceptions, interpretations, modifications of conditions of prior approvals, continuation of any preexisting non-conforming conditions, conditional use approval, other approvals reflected on the plans (as same may be further amended or revised from time to time without further notice) as may be determined to be necessary during the review and processing of the application by the Board and its professional staff, and permits requested or required by the Board at the public hearing.
