DIVISION OF LAND PROTECTION, NOTICE OF APPROVED ADMINISTRATIVE SETTLEMENT PURSUANT TO 42 U.S.C. § 9613(f)

The Division of Land Protection ("DLP") has accepted into its Brownfield Program an approximately 5.84-acre parcel of property to facilitate the enhancement or redevelopment of Site #47-655 S1 (the "Site) by Storage Five Development, LLC, a Tennessee limited liability company ("Storage Five") and prospective property owner pursuant to and upon acquisition of each, or any, parcel from current owner(s). This notice serves the multiple purposes of giving notice about Storage Five's status as a successor to the present Site Owners and Consenting Parties, notice of the terms of its own Brownfield Voluntary Agreement to the general public, providing notice to third parties who may assert contribution claims pursuant to 42 U.S.C. § 9613(f) et seq. or other laws, and requests written comments (if any).
The Site presently is owned by Children's Trust No. 1 of Claude J. Yow, G. Avery Yow, Co-Trustee, Bryan Yow, Co-Trustee, Claude J. Yow and Frances M. Yow (the "Consenting Parties") and is the subject of a Brownfield Voluntary Consent Order between the Consenting Parties and TDEC's Division of Remediation that includes liability protection for the Consenting Parties and any successor parties, including protection against third-party contribution claims regarding matters identified and addressed in the Consent Order.
The Site was undeveloped from at least 1939 until 1968. The Site was developed in 1968 with a portion of the present-day industrial structure, later undergoing significant improvement in 1977, reflecting the present configuration. Historical Site tenants include London Fog Coats, a textile manufacturer, from at least 1968 until the late 1980s; Knox Knits, Inc. beginning in approximately 1990; and Cra-Tex Mills, a jump rope textile manufacturing business, from at least 1995 until at least 2016. In addition, the Site was historically occupied by a variety of metal fabrication businesses, including AmeriFlex, Inc., in approximately 1995; and Fab Metal, which occupied the Site from at least 2003 until 2023. Remaining historical tenants include a variety of light commercial/industrial, retail-based, or otherwise distribution-based tenants.
A Phase II Environmental Site Assessment was conducted by and on behalf of the Voluntary Party in or around January 2025, which found the Site was impacted by historical onsite textile operations. Specifically, groundwater sampling revealed benzo(a)pyrene and perfluorooctane sulfonic acid (PFOS) at concentrations above their respective U.S. Environmental Protection Agency (EPA) Maximum Contaminant Levels (MCL). Further, the 2025 Phase II ESA indicated Arsenic detections onsite exceeded the EPA industrial Regional Screening Levels (RSLs) in soil but are below TDEC's acceptable threshold of 20 mg/kg. Chromium was detected onsite at a concentration that exceeds the industrial RSL but fell within TDEC's acceptable range for chromium in the area. Acetone, 2-butanone (MEK), methylene chloride, toluene, benzo(a)-anthracene, benzo(b)fluoranthene, benzo(a)pyrene, chrysene, barium, lead, and mercury were detected in onsite soil at concentrations below industrial RSLs. There is no evidence that any of these constituents pose an unacceptable threat to human health at any adjacent site.
In February 2026, a further Limited Phase II ESA investigation was performed by and on behalf of the Voluntary Party, Storage Five. The 2026 Limited Phase II ESA again confirmed the Site was impacted by historical onsite commercial, industrial and textile operations. Specifically, the 2026 sampling revealed in any detections that all concentrations are below the EPA industrial RSLs and that all PFOS (PFAS) samples were below laboratory detection limits. There is no evidence that any of these constituents pose an unacceptable threat to human health at any adjacent site.
The Site is zoned for commercial development. The Voluntary Party, Storage Five, also is a Successor Party to the Consenting Parties. Storage Five proposes to use the Site and subject property for commercial and warehouse development purposes. has not and did not cause, nor contribute to, any actual or perceived adverse environmental conditions at the Site.
The Site has been the subject of environmental investigations, the results of which have been reviewed by TDEC. All reports of the investigation and remediation of the Site are on file with the Division of Land Protection. These investigations conclude that the Site has been impacted by real or perceived hazardous substances, solid waste, or other pollutants, determined to be present in this Site relating to the historical operations at the site and/or at neighboring properties. Due to the presence of these constituents, a Notice of Land Use Restrictions has been or will be placed on the Site to limit certain future activities there. A Site Management Plan was prepared and will be followed during development activities. These and other measures required by DLP under the Agreement for the Site will ensure protection of human health and the environment.
