PUBLIC NOTICE
Please take notice that 450-452 Cooper Street LLC ("Applicant") has filed an application for development with the City of Beverly Joint Land Use Board ("Board") regarding real property located at 450-452 Cooper Street and designated as block 1168, lot 6 on the municipal tax map. The property is located in the C-2 zoning district. The property is approximately 0.187 acres and is currently improved with a 2 ½ story mixed use building with a small commercial space and three apartments, as well as a gravel parking area at the rear. The Applicant seeks minor site plan approval, a D(1) use variance, bulk variances and waivers, along with any other approvals required to convert the existing mixed-use building into four (4) apartments. The Applicant also seeks to approval to construct an addition at the rear of the building and expand and pave the rear parking area, along with associated improvements.
The Applicant seeks approval of the following variances under the municipal land use ordinance:
1. Section 600-28(a) states apartments are not a permitted principal use. However, Section 600-10A permits apartments above first floor of commercial establishments, offices and facilities as a principal used in the C-2 zoning district if specific conditions are met. A d(l) use variance is required, as the proposed use will be four (4) apartment units, located on the first and second floors, with no commercial use proposed.
2. Per the 2007 Redevelopment Plan, a solid fence, landscape screen or combination thereof shall be provided along any property line where commercial use abuts residential use. The Applicant proposes no solid fence or landscape screen between Lot 6 (to be a residential use) and Lot 8 (which contains a commercial use).
3. Section 600-28B(1)(i) states refuse enclosures are permitted accessory uses. The Schedule of Area and Bulk Requirements states that accessory buildings and structures are only permitted in the side and rear yards of the C-2 zoning district. Per the definition of a yard, the proposed refuse enclosure is located within the front yard, due to the site's two frontages.
4. Section 600, Attachment 1 requires a minimum lot width of 50 ft. The existing lot width is 42.33 ft. This is an existing nonconformity, and no change is proposed.
5. Section 600, Attachment 1 requires a minimum single side yard setback of 5 ft. The existing side yard setback along the southeastern sideline is 1.82 ft. This is an existing nonconformity, and no change is proposed.
6. Section 600-15(D) requires a minimum landscape buffer area of 3 ft in rear yards, where there is currently no rear yard landscape buffer. The Applicant proposes a 2.16 ft landscape buffer in the rear yard.
The Applicant also requests any additional variances, submission waivers, additional exceptions, design waivers, de minimis exceptions, interpretations, modifications of conditions of prior approvals, continuation of any preexisting non-conforming conditions, conditional use approval, other approvals reflected on the plans (as same may be further amended or revised from time to time without further notice) as may be determined to be necessary during the review and processing of the application by the Board and its professional staff, and permits requested or required by the Board at the public hearing.
This application shall be considered by the Board on June 24, 2026 at 6:30 p.m. in-person at the City of Beverly, Frank R. Costello Municipal Building, Council Chambers, 446 Broad Street, Beverly, New Jersey, at which time you may appear either in person or through an attorney and present any objection that you may have to the granting of this application.
