PUBLIC NOTICE
Please take notice that Deptford Chicken LLC ("Applicant") has filed an application for development with the Deptford Township Planning Board ("Board") regarding real property located at 1750 Deptford Center Road, which is designated as block 200.01, lot 19 on the municipal tax map. The property is located in the BC-2 zoning district. The Applicant seeks preliminary and final major site plan approval to develop a portion of the existing Deptford Mall parking area, located between Mall Loop Road, the Almonesson-Westville Road signalized entrance, and Fulton Bank. The proposed development consists of a 2,935-sf restaurant with 2 drive thru lanes and associated parking.
The Applicant seeks approval of the following variances under the municipal land use ordinance:
1. Front Yard Setback Variance. Section 17.1.I.6.d allows a minimum front yard setback of 15 feet for principal buildings and pad site buildings of less than 8,500 sf. in gross floor area, provided that the front façade of the building facing a public street is integrated into the streetscape design requirements for color and materials. The Applicant proposes a building with a front façade that does not face the street, and the side elevation facing Almonesson Road has color and materials that do not integrate with the streetscape.
2. Maximum Number of Wall Signs Variance. Section 30.K.10.B permits a total of two wall signs. The applicant proposes a total of 20 wall signs.
3. Maximum Size of Wall Signs Variance. Section 30.K.10.a and Section 30.L.4.d provide that no wall sign shall exceed 5% of the total façade area to which it is attached or 60 square feet, whichever is less. The combined area of the proposed wall signs is approximately 480 sf. (approximately 14% of the total façade area).
4. Location of Wall Signs Variances. Section 30.K.10.c does not permit wall signs on the rear of the building, and restricts the placement of wall signs to (1) above first floor windows; (2) below a parapet, mansard roof or pent roof; or beside the main entrance. The Applicant proposes a stylized "Z" sign that wraps from the side of the building to the rear façade. The Applicant proposes wall signs at window level which are not beside the main entrance.
5. Drive-thru Sign Variance. Section 30-K.7.b permits restaurants with a drive-thru facility to have two freestanding menu signs oriented to the motorist in the drive-thru lane. The applicant proposes two freestanding menu signs and two "Pre Sale" signs before each menu board.
6. Projecting Sign Variance. Section 30-K.9 provides that projecting signs must have a minimum clearance of the lower edge of any such sign shall be no less than nine feet; a minimum distance between any edge of the sign and a building façade of no less than six inches; and a maximum distance between the sign and building façade of six feet, six inches. The Applicant proposes projecting signs that do not meet these requirements.
7. Canopy Sign Variance. Section 30-L.4.k.3 permits canopy signs in the BC-2 zoning district only for automobile service stations. The applicant proposed signs located on the canopy over the payment window and on the ordering canopy.
8. Location of Freestanding Directional Sign Variance. Section 30.K.4.B.1 does not permit freestanding directional signs within 50 feet of the tract perimeter. The applicant proposes two freestanding directional signs set back 15.41 feet from the tract perimeter.
The Applicant also requests any additional variances, submission waivers, exceptions, design waivers, de minimis exceptions, interpretations, modifications of conditions of prior approvals, continuation of any preexisting non-conforming conditions, conditional use approval, other approvals reflected on the plans (as same may be further amended or revised from time to time without further notice) as may be determined to be necessary during the review and processing of the application by the Board and its professional staff, and permits requested or required by the Board at the public hearing.
This application shall be considered by the Board at a public hearing on August 5, 2026 at 6:00 p.m. in-person at the Deptford Township Municipal Building, Courtroom, 1011 Cooper Street, Deptford, New Jersey, at which time you may appear either in person or through an attorney and present any objection that you may have to the granting of this application. A copy of the application and supporting documentation is on file in the Board's office in the Deptford Township Municipal Building, 1011 Cooper Street, Deptford, New Jersey, and is available for public inspection during regular business hours.
