Notice of an Amendment to a Brownfield Voluntary Agreement

The Division of Remediation ("DoR") is amending an existing Brownfield Voluntary Agreement covering an approximate 0.568-acre property located at 210 4th Avenue North, Nashville, which is assigned Division site number 19-594 and is commonly known as the Sandy Parcels Site. The Sandy Parcels Site is subject to an existing Brownfield Voluntary Agreement ("Agreement") between 210 Fourth, LLC and DoR dated September 21, 2010, and an existing Notice of Land Use Restrictions ("NLUR") recorded as Document 20091214-0113967 with the Davidson County Register of Deeds on December 14, 2009.
The Sandy Parcels Site is part of a larger property ("Property") that is currently occupied by the Bridgestone Tower office building. The existing Agreement and NLUR do not cover the entire Property, which is a block covering approximately 0.985 acres that was purchased by Highwoods Realty Limited Partnership ("Highwoods") in October 2014 and subsequently conveyed to the Industrial Development Board of the Metropolitan Government of Nashville and Davidson County and leased to Highwoods under a PILOT lease. The amendment to the Agreement and NLUR will reflect the current Property boundaries and the current ownership structure. No changes to the current use of the Property will occur. Pursuant to Tennessee Code Annotated § 68-212-224, this letter serves the purpose of providing notice to the general public of the terms of the proposed amendment to the Agreement.
The Property was previously the subject of environmental investigations during the course of development, the results of which have been reviewed by DoR. All reports of the investigation and remediation of the Property are on file with the DoR. These investigations concluded that the Property had been impacted by petroleum-related constituents (i.e., benzene) and metals in site soil and shallow groundwater. Impacted media were removed from the Property during development pursuant to a DoR-approved Soil Management Plan. The existing NLUR requires notification to DoR of any proposed land use that may expose humans to residual soil and groundwater contamination; any proposed soil removal; and any invasive activity that could generate fugitive dust, such as soil borings or potable groundwater wells. The NLUR requires demonstration to the satisfaction of DoR that these activities will not pose a danger to public health, safety, or the environment.
