The purpose of the public hearing will be to investigate a delineated area known as and including Block 102, Lot 9, as shown on the Official Tax Map of the Township of Nutley and located at 300 Kingsland Street (hereinafter referred to as the "Study Area"), to determine whether such delineated area should be designated as a Non-Condemnation Area in Need of Redevelopment.
A map showing the boundaries of the Study Area and a statement setting forth the basis of the preliminary investigation is on file and available for public inspection and copying with the Township Clerk at the Municipal Building, located at 1 Kennedy Drive, Nutley, New Jersey 07110, during normal business hours. At the conclusion of the public hearing, which may be carried from time to time, the Board will vote on whether or not to recommend to the Township of Nutley Board of Commissioners that the Study Area qualifies as a Non-Condemnation Area in Need of Redevelopment, pursuant to the criteria established in N.J.S.A. 40A:12A-5 and under the definitions of "redevelopment area" and "area in need of redevelopment," as set forth in N.J.S.A. 40A:12A-1, et seq.
A determination that the Study Area constitutes a Non-Condemnation Area in Need of Redevelopment shall not authorize the Township of Nutley to exercise the power of eminent domain to acquire any property in the Study Area.
Members of the public interested in, or who would be affected by a potential determination that the Study Area is, or is not, a Non-Condemnation Area in Need of Redevelopment may, either directly or through counsel, and either orally or in writing, participate and be heard at the hearing.
