PUBLIC SPECIAL HEARING NOTICE CITY OF PATERSON ZONING BOARD OF ADJUSTMENT PASSAIC COUNTY

PUBLIC SPECIAL HEARING NOTICE CITY OF PATERSON ZONING BOARD OF ADJUSTMENT PASSAIC COUNTY PLEASE TAKE NOTICE that on June 30, 2026, at 7:30 p.m. at the Council Chambers of the City of Paterson City Hall, 155 Market Street, Third Floor, Paterson, New Jersey 07505, the City of Paterson Zoning Board of Adjustment will hold a public special hearing on an application filed by Paterson Charter School for Science and Technology, Inc. (the "Applicant") seeking Preliminary and Final Major Site Plan approval, bulk variances, and "d(2)" Expansion of Nonconforming Use Variance relief to alter and expand the pre-existing charter school. It is the Applicant's position a "d(2)" Expansion of Nonconforming Use variance is triggered, but in the event the Board or its professionals determine that a "d(1)" Use variance is required, then Applicant will request the same. The subject property (referred to herein as "the Site") is identified as Block 7104, Lots 8, 9, 10, 12, 13, 16, 17, 18 & 19, in the Mixed Use (M-U) Zoning District, and the addresses of the Lots, respectively, are 262-266 Wabash Avenue, 268-278 Wabash Avenue, 280-284 Wabash Avenue, 290 Wabash Avenue, 292 Wabash Avenue, 255-259 Buffalo Avenue, 69-75 Lehigh Avenue, 49-67 Lehigh Avenue, and 45-47 Lehigh Avenue. Applicant seeks to modernize the Site and enhance its safety by including the following accessory uses, which require relief: 1. Outdoor learning space/amphitheater; 2. Recreational court (e.g., basketball, volleyball, general playground); 3. New parking lot; 4. Walkway canopy; 5. Digital signs; 6. New parking layout with a drop-off lane; and 7. Façade face lift. More specifically, the following improvements are sought: Southern Parking Lot along Wabash Avenue Restriping of15 parking spaces, 3 of which will be EV make readySecurity fence/sliding gate at the parking lot entrance The number of parking spaces shall remain undisturbed. Northern Parking Lot along Wabash Avenue - Convert the parking lot to a multi-use recreational space - Create an outdoor learning space/amphitheatre - New vestibuleImprovements to the building's façade - Install a canopy walkway from Wabash Ave. to the school with a pedestrian security fence/gate - Install a wall with security fencing and a gate along Wabash Ave. - Lighting install extension poles on top of the security fence with a sports net - Install an electronic sign inside the wall To accomplish the above, there will be a reduction of 29 parking spaces, as the parking lot will be converted to a multi-use recreational area. Existing Paved Recreational Area along Wabash Avenue - Install a parking lot with 25 new parking spaces, 2 of which will be ADA spaces - Add perimeter landscaping - Install a wall with security fencing/gate along Wabash Ave. - Add lighting The new parking lot will create 25 parking spaces, which will offset the reduction of the 29 parking spaces discussed above. Existing Paved Lot on Leigh Avenue - Restripe existing parking lot consisting of 26 parking spaces, 2 of which will be ADA compliant - Install a security fence/sliding gate at the parking lot entrance - Add perimeter landscaping Total Parking Spaces As a result of the above, the total parking spaces will be as follows: Existing 79/ Required 79/ Proposed 90 (3 of which are EV make-ready). The Applicant further proposes the construction of an approximately 19,523 square foot building including stairs on the first floor and a vestibule. The addition will include approximately 3,758 square foot auditorium with a capacity of 411 people. The addition will also consist of 7 classrooms, 2 smaller classrooms, a teacher's lounge, office, media room, and other small rooms to further advance the needs of students. The Site is currently utilized as an elementary/middle school (grades 4-7). The proposed use is not permitted within the M-U District. The Applicant is the owner. Bulk variance relief under N.J.S.A. 40:55D-70(c) and use variance relief under N.J.S.A 40:55D-70(d)(2) and/or N.J.S.A 40:55D-70(d)(1) is triggered. Applicant seeks, among other things, approval to install illuminated signs. Under Paterson's municipal code §500-8.3c, digital signs are prohibited in all districts. Since the school is not permitted in the zone, the installation of the digital signs constitutes an expansion of a nonconforming use (d2) or, in the alternative, a use variance (d1). Applicant seeks such relief. The following is an existing non-conforming condition: minimum lot width because 100' is required, 75' is existing, and 75' is proposed. A variance is also needed for minimum rear yard setback because 30' is required, 74.7' is existing, and .2' is proposed. The following is an existing non-conforming condition: minimum side yard setback (single) because 10' is required, 0' is existing, and 0' is proposed. A variance is also needed for maximum lot (building) coverage because 60% is required, 62.6% (62,516 s.f.) is existing, and 77.2% (77,167 s.f.) is proposed. The following is an existing nonconforming condition: minimum parking space size for 0-degree parking spaces because 9' x 22' is required, 9.2' x 18' is existing, and 9.2' x 18 is proposed. A variance is also needed for minimum aisle width for 90-degree parking spaces because 24' is required, 16.3' is existing, and 20' is proposed. A variance is also needed for minimum aisle width for 80-degree parking spaces because there is no requirement, none exists, and 20' is proposed. The following is an existing non-conforming condition: minimum distance from parking to side and rear property line because 3' is required, 0' is existing, and 0' is proposed. Applicant will also seek all additional relief identified throughout the application process, including, but not limited to, other use or bulk variances, exceptions, or waivers. The school is an inherently beneficial use, which under the New Jersey Municipal Land Use Law (MLUL) N.J.S.A. 40:55D-4 is one that by its nature serves the public good (i.e., education). The application is on the referenced Zoning Board of Adjustment's public special hearing agenda to be held on June 30, 2026, at 7:30 p.m. at the Council Chambers of the City of Paterson, City Hall, 155 Market Street, Third Floor, Paterson, New Jersey 07505. When this case is called, you may appear either in person, by agent, or by an attorney, and present any comments or objections which you may have to the granting of the relief sought in the application. Any interested party may appear at said hearing and participate therein in accordance with the rules of the City of Paterson Zoning Board of Adjustment. If you have no objections to this matter, you do not have to be present at the meeting.
