PUBLICE NOTICE FOR PUBLIC HEARING
TOWNSHIP OF EAST HANOVER LAND USE AND PLANNING BOARD
PLEASE TAKE NOTICE, that on Tuesday, October 28, 2025 at 7:00 P.M. the Township of East Hanover Land Use & Planning Board ("Board") will hold a PUBLIC HEARING at Town Hall, Council Chambers, 411 Ridgedale Avenue, Township of East Hanover, New Jersey, on the application of the applicant, Ridgedale 90 LLC (the "Applicant"), to permit the existing bicycle repair shop tenant to conduct retail sales and relief from a prior resolution condition to permit seating for the delicatessen tenant. No site improvements are proposed at the property located at 90 Ridgedale Avenue, East Hanover, New Jersey (Block 130, Lot 6), (the "Property"). Applicant is the owner of record. The Property is located in the I-3 Light Industry Zone.
The Application requires bulk variance relief from the following sections of the Township's Land Development Code: (1) Section 95-59B.(3) – D(1) variance to conduct retail sales within the existing bicycle repair shop tenant space, not permitted by the ordinance; (2) Section 95-59B.(3) – D(2) variance for expansion of the non-conforming deli use by adding 25 indoor seats and 40 outdoor seats wherein the supplementary parking is based on the number of seats. The deli use was previously granted via Resolution No. 11-1996; (3) Section 95-47A.(5) – variance to permit an outdoor display for the bicycle tenant, prohibited by the ordinance; (4) Section 95-47A.(6) – variance for outdoor seating for the delicatessen, not permitted in the zone; (5) Section 95-47A.(6)(a) – variance for number of outdoor seats proposed of 25 indoor seats and 40 outdoor seats, which equates to 160% of the interior seating, wherein only 20% of the interior seating is permitted; (6) Section 95-59D.(1)(a) – the existing shed has a 4.34 side yard setback, wherein a 10-foot side yard setback is required; and relief from (a) Condition E of Resolution No. 11-1996 – Condition E states, "No consumption or sit down service shall be permitted on the property." The Applicant seeks relief from this condition to permit 25 indoor seats and 40 outdoor seats associated with the current delicatessen tenant, which would allow for on-site consumption; and (b) Condition H of Resolution No. 11-1996 – Condition H states, "Retail hours of operation shall be limited to Monday through Saturday, 8:00 a.m. to 6:00 p.m. and Sunday, 8:00 a.m. to 2:00 p.m." The Applicant is requesting to modify the hours of operation of the deli and bike shop to be seven days a week from 6:00 a.m. to 9:30 p.m.; and any additional deviations, variances, waivers, exceptions, interpretations, de minimis exceptions to RSIS, modifications of conditions of prior approvals, continuation of any preexisting nonconforming conditions and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and/or relief that may be determined to be necessary during the review and processing of the application and/or based upon an analysis of the plans and testimony at the PUBLIC HEARING on the Application, as the application may be amended to include same as determined by the Board.
