To: Robert Kovach and to all other persons interested. A petition had been presented to said Court by Nicole DiMauro of Arlington in the County of Middlesex representing that he hold as tenant in common ___ undivided ___ part or share of __ certain land lying in Fitchburg in said County Worcester and briefly as follows:
Legal Description:
A certain parcel of land, with the buildings and other improvements theron, situated on the westerly side of Pearl Hill Road and northerly side of Juniper Road, in Fitchburg, Worcester County, Massachusetts, more particularly bounded and described as follows:
BEGINNING at the most northeasterly corner thereof on the westerly side of Pearl Hill Road at iron pipe at land now or formerly of David Myers, et ux:
THENCE S. 31' 30'E., by westerly side of Pearl Hill Road, 127 feet to point of curvature;
THENCE by a curve to the right having a radius of 30 feet, a distance on the arc of 54.43 feet to a point of compound curvature;
THENCE by a curve to the right having a radius of 460 feet, a distance on the arc of 230.53 feet, by the northernly side of Juniper Road to a concrete bound at land now or formerly of Gifford K. Simonds, Jr., et ux.
THENCE N. 1' 38" E. by land of said Gifford K Simonds, Jr. 97.65 feet to an iron pipe at land now or formerly of David M. Myers, et ux;
THENCE N. 68' 53' 40" E., by land of said David M Myers. et ux, 187.75 feet to the point of beginning.
Containing 31,079 square feet.
The above described premises are shown as all of Lot 7 and the portion of Lot 6 on a plan of land owned by Gifford K. Simonds, dated August 1940, by Rowland H. Barnes & Co., Civil Engineers, Newton & Waltham, Mass.;
setting forth that he/she desire that all the aforesaid described part of said land may be sold at private sale not less than Five Hundred Eighty Four Thousand Nine Hundred ($584,900) dollars, and praying that partition may be made of all the land aforesaid according to lay, and to that end that a commissioner by appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale or public auction, and be ordered to distribute the net proceeds thereof.
If you desire to object therto you or your attorney should file a written appearance in said Court at Worcester before ten o'clock in the forenoon on the 21st day of July that return day of this citation.
