To: Marshall L. Rice and to all other persons interested.
A petition has been presented to said Court by Steven H. Foskett
of Shrewsbury in the County of Worcester representing that he
hold as tenant in common undivided part or share of certain land
lying in Worcester in said County of Worcester and briefly as follows:
The petitioner desires that all the following described Land may be ordered to
be sold at private sale for not less than Seventy-Five Thousand Dollars
($75,000.00).
Per Deed, about 7,500 square feet of land situated on the westerly side of Brookline Street being designated on Assessors' Plan as Lots 68 and Part of 67, Book 42, Page 7.
Grantors obtained title through estate of their mother, Jane D. Rice, Administration filed Worcester Probate Court Docket No. 302533 and will of grantors' father, Ernest P. Rice; said will field Worcester Probate Court Docket No. 271295.
Said premises being adjacent premises to Lots 69 and 70 of the same assessor's plan and transferred to Steven H. Foskett and Deborah J. Foskett dated July 15, 1976 and recorded with Worcester Registry of Deeds Book 5981, Page 284.
Said grantors only grant any interest that they may have obtained from the estate of and will of their parents.
Said grantors further states that there remains to the best of their knowledge, an outstanding interest in these premises with their brother, Marshall L. Rice, presently of parts unknow.
Being the same premises conveyed to Steven H. Foskett and Deborah J. Foskett by deed dated November 10, 1983 and recorded with the Worcester District Registry of Deeds in Book 7999, Page 59.
Wherefore your petitioner prays that partition be made of all-the above Land described aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any portion of, said Land which the Court finds cannot be advantageously divided, either at private sale or public auction, and be ordered to distribute and pay over the net proceeds thereof in such manner as to make the partition just and equal. The petitioner certifies under the penalties of perjury that the statements herein contained are true to the best of his knowledge and belief.
setting forth that he/she desire that all the aforesaid described part of said land may be sold at private sale not less seventy-five thousand (75,000) dollars, and praying that partition may be made of all the land aforesaid according to law, and to that end that a commissioner be appointed to make such partition and be ordered to make sale and conveyance of all, or any part of said land which the Court finds cannot be advantageously divided either at private sale and be ordered to distribute the net proceeds thereof.
If you desire to object thereto you or your attorney should file a written appearance in said Court at Worcester before ten o'clock in the forenoon on the fourteenth day of October the return day of this citation.
