has applied to the Zoning BOARD OF THE TOWNSHIP OF MANALAPAN for a variance
from the Manalapan Township Land Use Ordinance:
SECTION NO. 95-7 .24.C - Fences: Setback Requirements in Residental Zone. Districts; 95-7.8-Accessory Buildings and Structures. Located in Zoning District R-20 (Single Family Residential)
REASON (include proposed work and cite Zoning Officer's denials)
95-7.24C In residential zones, fences shall not exceed 3 feet in height in a front yard. Pursuant to 95-5.1 (ex. 5-1), the minimum required front setback for properties in the R-20 Zone that front on a collector road is 75 feet. A 6 foot high fence is proposed with a front setback of 38 feet from westerly front lot line (Pension Road frontage). 95-7.8F - A porch, deck, patio, or similar structure that is not covered with a roof and is not greater than 6" above grade shall conform to the setback requirements accessory structures; pursuant to 95-5.1 (exhibit 5-1), the minimum required side setback for accessory structures in this Zone is 15 Feet, whereas the existing patio in the westerly side yard, which was constructed without a zoning permit, provides a setback of 2 feet.
