Pubic Notice
PLEASE TAKE NOTICE that the applicant, New York SMSA Limited Partnership d/b/a Verizon Wireless ("Applicant"), the lessee of a portion of the property located at 11 Nevins Road, Wayne, New Jersey 07470, also known as Block 3103, Lot 14.06 on the Tax Assessment Map (hereafter referred to as the "Property"), has made application to the Wayne Township Zoning Board of Adjustment for use variance, bulk variances and site plan approval, with waivers, to install a temporary wireless telecommunication facility including, but not limited to, a 120 foot tall ballast mount monopole/tower with 9 panel antennas attached thereto and ground based equipment cabinets and appurtenances within a 30 foot x 30 foot fenced compound (hereafter referred to as the "Facility") on the Property in the OR Office and Research Zone ("OR" Zone). The Property is currently utilized as the auxiliary parking lot for the Ice Vault skating arena and the Facility will occupy 4 existing parking spaces and will result in the loss of 6 parking spaces overall. The Facility is proposed for a period of two (2) years until such time as the Applicant can re-establish a permanent wireless telecommunication facility in the area since the Applicant's existing rooftop wireless telecommunication facility located at 1655 Valley Road, Wayne, N.J. must be decommissioned due to the impending demolition and redevelopment of the existing building thereon.
Since wireless telecommunication facilities are not a permitted use in the OR Zone, the Applicant is requesting D(1) use variance approval from Sec. 134-69.2A & Sec. 134-47.1 of the Zoning Ordinance. In addition, the Applicant requests the following additional variances: (i) Bulk Variance from Sec. 134-69.5B, since the minimum required tower setback is the height of the tower (i.e., 120 feet), whereas, 31.95 feet is proposed from the southwesterly property line to the proposed monopole; (ii) Bulk Variance from Sec. 134-69.5C, since the minimum required equipment compound setback is the height of the tower (i.e., 120 feet), whereas, 23.5 feet is proposed from the southwesterly property line to the Facility's equipment compound; (iii) Bulk Variance from Sec. 133-472E(2) & 134-47.2F(1) since the minimum side yard setback in the OR Zone is 50 feet, whereas 23.59 feet is proposed from the southwesterly property line to the Facility's equipment compound; and (iv) a D(6) height variance from Sec. 134-69.5D(3) and 134-47.2H(1) as the maximum permitted height for a single-user tower is 100 feet and the maximum permitted structure height in the OR Zone is 35 feet, whereas, the proposed monopole will be 120 feet tall. Finally, the Applicant requests any additional approvals, variances, waivers, exceptions or any other relief which may be deemed necessary upon review of the application by the Zoning Board of Adjustment.
A public hearing to consider and take action on this application will be held by the Zoning Board of Adjustment on April 6, 2026 at 7:30 p.m. in the Township of Wayne Council Chambers located in the Municipal Building Hall, 475 Valley Road, Wayne, N.J. 07470. Any interested person or persons shall have an opportunity to be heard upon such application, either by their own representation or by attorney. In addition, the Township intends to broadcast the meeting. Television access will be available on the local cable T.V. channel and on the Township's web site.
All documents relating to this application will be available for public review at least ten (10) days prior to the aforesaid meeting during regular business hours (8:30 a.m. to 4:30 p.m. Monday through Friday and until 7:30pm Tuesdays) in the office of the Planning Department located in the Municipal Building, 475 Valley Road, Wayne, New Jersey 07470. This notice is being sent to you by the Applicant as required by the State of New Jersey's Municipal Land Use Law (N.J.S.A. 40:55D-10 and 12).
